1-21 A BILL TO BE ENTITLED
1-22 AN ACT
1-23 relating to a requirement that an operator service make a live
1-24 operator available.
1-25 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-26 SECTION 1. Section 18A, Public Utility Regulatory Act
1-27 (Article 1446c, Vernon's Texas Civil Statutes), is amended by
1-28 amending Subsection (h) and adding Subsection (i) to read follows:
1-29 (h) Except as provided by Subsection (i) of this section,
1-30 this <This> section applies only to a telecommunications utility
1-31 that is not a dominant carrier. The commission is granted all
1-32 necessary power and authority under this Act to promulgate rules
1-33 and establish procedures for the purposes of enforcing and
1-34 implementing this section.
1-35 (i) Each dominant or nondominant telecommunications utility
1-36 that provides operator service shall ensure that a caller may
1-37 access a live operator at the beginning of all live or mechanized
1-38 operator assisted calls through a method designed to be easily and
1-39 clearly understandable and accessible to the caller. A
1-40 telecommunications utility shall submit to the commission the
1-41 method by which the utility will provide access to a live operator
1-42 for review. This subsection applies regardless of the method by
1-43 which the telecommunications utility provides the operator service.
1-44 The requirements of this subsection shall not apply to telephones
1-45 located in prison or jail facilities.
1-46 SECTION 2. This Act takes effect September 1, 1993.
1-47 SECTION 3. The importance of this legislation and the
1-48 crowded condition of the calendars in both houses create an
1-49 emergency and an imperative public necessity that the
1-50 constitutional rule requiring bills to be read on three several
1-51 days in each house be suspended, and this rule is hereby suspended.
