1-21 A BILL TO BE ENTITLED
1-22 AN ACT
1-23 relating to the issuance of general obligation bonds for projects
1-24 relating to state prisons and to an emergency appropriation to the
1-25 Texas Department of Criminal Justice for the operation of state
1-26 prisons and intermediate sanction facilities, discretionary grants,
1-27 and payments to counties.
1-28 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-29 SECTION 1. From the unissued balance of general obligation
1-30 bonds that are authorized under Article III, Section 49-h, of the
1-31 Texas Constitution, the Texas Public Finance Authority shall issue
1-32 bonds in the amount of $125 million and distribute the proceeds for
1-33 the purposes specified in the emergency appropriation for the Texas
1-34 Department of Criminal Justice made by Subsection (b) of Section 2
1-35 of this Act.
1-36 SECTION 2. (a) In this section, "current General
1-37 Appropriations Act" means House Bill No. 1, Acts of the 72nd
1-38 Legislature, 1st Called Session, 1991.
1-39 (b) In addition to amounts previously appropriated under the
1-40 current General Appropriations Act or other law for the current
1-41 fiscal biennium, the sum of $125 million is appropriated to the
1-42 Texas Department of Criminal Justice from the proceeds of the
1-43 issuance of bonds previously authorized under Article III, Section
1-44 49-h, of the Texas Constitution for the two-year period beginning
1-45 on the date the proceeds are available:
1-46 (1) for the payment of expenses incurred in acquiring,
1-47 constructing, or equipping new prisons; and
1-48 (2) to repay items of appropriation in the current
1-49 General Appropriations Act or Article 22, Chapter 10, Acts of the
1-50 72nd Legislature, 2nd Called Session, 1991, from which funds were
1-51 transferred or expended for start-up expenses incurred in
1-52 acquiring, constructing, or equipping new prisons.
1-53 (c) In addition to amounts previously appropriated under the
1-54 current General Appropriations Act or other law for the current
1-55 fiscal biennium, the sum of $125.8 million is appropriated to the
1-56 Texas Department of Criminal Justice from the economic
1-57 stabilization fund for the period beginning on the effective date
1-58 of this Act and ending on August 31, 1993, for:
1-59 (1) the operation of additional capacity;
1-60 (2) the operation of intermediate sanction facilities;
1-61 (3) discretionary grants;
1-62 (4) payments to counties in the manner provided by
1-63 Subdivision (1), Subsection (a), Section 22.01, Chapter 10, Acts of
1-64 the 72nd Legislature, 2nd Called Session, 1991, and court-ordered
1-65 payments to counties; and
1-66 (5) repayment of items of appropriation in the current
1-67 General Appropriations Act or Article 22, Chapter 10, Acts of the
1-68 72nd Legislature, 2nd Called Session, 1991, from which funds were
2-1 transferred or expended for the payment of expenses incurred for
2-2 the purposes listed in Subdivisions (1) through (4) of this
2-3 subsection.
2-4 SECTION 3. The importance of this legislation and the
2-5 crowded condition of the calendars in both houses create an
2-6 emergency and an imperative public necessity that the
2-7 constitutional rule requiring bills to be read on three several
2-8 days in each house be suspended, and this rule is hereby suspended,
2-9 and that this Act take effect and be in force from and after its
2-10 passage, and it is so enacted.
