No. 172 By: Sims 1-21 A BILL TO BE ENTITLED 1-22 AN ACT 1-23 relating to pipeline easements. 1-24 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-25 SECTION 1. Subchapter B, Chapter 111, Natural Resources 1-26 Code, is amended by adding Section 111.0194 to read as follows: 1-27 Sec. 111.0194. PIPELINE EASEMENTS. (a) Unless the terms of 1-28 the grant or the condemnation judgment expressly provide otherwise, 1-29 or the easement rights otherwise prescriptively owned through 1-30 actual use are greater, an easement created through grant or 1-31 through the power of eminent domain for the benefit of a single 1-32 common carrier pipeline which exercises the power of eminent domain 1-33 under Section 111.019 of this code as of the effective date of this 1-34 section is presumed to create an easement in favor of the common 1-35 carrier pipeline, or a successor in interest to the common carrier 1-36 pipeline, that extends only a width of 50 feet as to each pipeline 1-37 laid under the grant or judgment in eminent domain prior to 1-38 September 1, 1993. 1-39 (b) The presumption in Subsection (a) of this section is not 1-40 applicable to pipeline easements of a common carrier pipeline 1-41 granted under the terms of an oil and gas lease or oil, gas, and 1-42 mineral lease, or to any easement which authorizes the construction 1-43 of gathering lines. 1-44 (c) The presumption set out in Subsection (a) of this 1-45 section on the limitation of width may be rebutted by evidence on 1-46 behalf of the common carrier pipeline that a greater width is 1-47 reasonably needed for purposes of operation, construction of 1-48 additional lines under the grant or judgment in an eminent domain 1-49 proceeding, maintenance, repair, replacement, safety, surveillance, 1-50 or as a buffer zone for protection of the safe operation of the 1-51 common carrier pipeline, together with such other evidence as a 1-52 court may deem relevant to establish the extent of an easement in 1-53 excess of 50 feet in width. 1-54 (d) The presumption in Subsection (a) of this section shall 1-55 apply separately as to each pipeline under a grant or judgment 1-56 which allows more than one pipeline on the subservient estate. 1-57 (e) This section shall not be deemed to limit any rights of 1-58 ingress to or egress from easements that may exist under common 1-59 law. 1-60 SECTION 2. The importance of this legislation and the 1-61 crowded condition of the calendars in both houses create an 1-62 emergency and an imperative public necessity that the 1-63 constitutional rule requiring bills to be read on three several 1-64 days in each house be suspended, and this rule is hereby suspended, 1-65 and that this Act take effect and be in force from and after its 1-66 passage, and it is so enacted. 1-67 * * * * * 1-68 Austin, 2-1 Texas 2-2 May 7, 1993 2-3 Hon.
