A BILL TO BE ENTITLED
AN ACT
1-1 relating to participation in benefits from the Employees Retirement
1-2 System of Texas for certain law enforcement officers.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Subdivision (9), Section 811.001, Government
1-5 Code, is amended to read as follows:
1-6 (9) "Law enforcement officer" means a member of the
1-7 retirement system who has been commissioned as a law enforcement
1-8 officer by the Department of Public Safety, the Texas Alcoholic
1-9 Beverage Commission, the former State Purchasing and General
1-10 Services Commission<,> Capitol Area Security Force, the State Board
1-11 of Pharmacy, the Texas Racing Commission, or the Parks and Wildlife
1-12 Department and who is recognized as a commissioned law enforcement
1-13 officer by the Commission on Law Enforcement Officer Standards and
1-14 Education.
1-15 SECTION 2. Subsection (b), Section 814.104, Government Code,
1-16 is amended to read as follows:
1-17 (b) A member who is at least 55 years old and who has at
1-18 least 10 years of service credit as a commissioned peace officer
1-19 engaged in criminal law enforcement activities of the Department of
1-20 Public Safety, the Texas Alcoholic Beverage Commission, the former
1-21 State Purchasing and General Services Commission Capitol Area
1-22 Security Force, the State Board of Pharmacy, the Texas Racing
1-23 Commission, or the Parks and Wildlife Department, or as a custodial
1-24 officer, is eligible to retire and receive a service retirement
2-1 annuity.
2-2 SECTION 3. Section 815.505, Government Code, is amended to
2-3 read as follows:
2-4 Sec. 815.505. Certification of Names of Law Enforcement and
2-5 Custodial Officers. As of the last day of each fiscal year, the
2-6 Department of Public Safety, the Texas Alcoholic Beverage
2-7 Commission, the Parks and Wildlife Department, the State Board of
2-8 Pharmacy, the Texas Racing Commission <Purchasing and General
2-9 Services Commission>, and the Texas Department of Criminal Justice
2-10 <Corrections> shall certify to the retirement system the names of
2-11 employees and the amount of service each employee performed as a
2-12 law enforcement officer or custodial officer during that fiscal
2-13 year.
2-14 SECTION 4. This Act takes effect September 1, 1993.
2-15 SECTION 5. The importance of this legislation and the
2-16 crowded condition of the calendars in both houses create an
2-17 emergency and an imperative public necessity that the
2-18 constitutional rule requiring bills to be read on three several
2-19 days in each house be suspended, and this rule is hereby suspended.
