No. 213 73R3189 NSC-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to school crime reports and to model safe school 1-3 checklists. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. It is declared to be the public policy of this 1-6 state that public schools are to be considered sanctuaries of 1-7 safety and security for the children of the state and that efforts 1-8 of the executive, legislative, and judicial branches of state 1-9 government are to be directed toward the fulfillment of this 1-10 policy. 1-11 SECTION 2. Subchapter I, Chapter 21, Education Code, is 1-12 amended by adding Section 21.310 to read as follows: 1-13 Sec. 21.310. SCHOOL CRIME REPORT. (a) The State Board of 1-14 Education shall develop, after consultation with the Department of 1-15 Public Safety, a standard school crime report form to be used by 1-16 school districts. 1-17 (b) Each school district shall report quarterly to the State 1-18 Board of Education on the forms provided by the board information 1-19 about crimes committed on school campuses in the district. The 1-20 report must include: 1-21 (1) the types and frequency of criminal offenses 1-22 committed on school campuses in the district; 1-23 (2) a description of the crimes, including the 1-24 location, time, and circumstances of each crime and weapon used, if 2-1 any; 2-2 (3) a description of the offenders, including the age 2-3 and sex of each offender, the name of the school the offender 2-4 attends or a statement that the offender does not attend school, 2-5 and the status of the offender at the school attended; 2-6 (4) a description of the victims, including the age 2-7 and sex of each victim and: 2-8 (A) the name of the school the victim attends, 2-9 if the victim is a student; or 2-10 (B) the victim's occupation and position at the 2-11 school, if the victim is employed by the school; and 2-12 (5) the actions taken by the school in response to the 2-13 crimes. 2-14 (c) The State Board of Education shall compile the school 2-15 crimes information received from the school districts and shall 2-16 file with the governor and the presiding officer of each house of 2-17 the legislature: 2-18 (1) an annual report of crimes reported by the 2-19 districts in the preceding year; and 2-20 (2) biennial recommendations to promote school safety. 2-21 (d) The State Board of Education may adopt rules necessary 2-22 to implement this section. 2-23 SECTION 3. Subchapter Z, Chapter 21, Education Code, is 2-24 amended by adding Section 21.938 to read as follows: 2-25 Sec. 21.938. SAFE SCHOOL CHECKLIST. The State Board of 2-26 Education by rule shall develop a model safe school checklist that 2-27 a school district may use to assess a school's safety strengths and 3-1 weaknesses. The checklist must include procedures for: 3-2 (1) implementing a comprehensive safety plan; 3-3 (2) communicating discipline policies and procedures; 3-4 (3) implementing intra-agency and interagency 3-5 emergency plans; 3-6 (4) recording disruptive incidents; 3-7 (5) training staff and students; 3-8 (6) assessing buildings and grounds; 3-9 (7) handling visitors; 3-10 (8) assigning personnel in emergencies; 3-11 (9) communicating during emergencies and managing 3-12 emergencies; 3-13 (10) providing safe transportation; 3-14 (11) handling accidents; and 3-15 (12) communicating with law enforcement authorities. 3-16 SECTION 4. The State Board of Education shall develop and 3-17 distribute the school crime report form and the model safe school 3-18 checklist required by Sections 21.310 and 21.938, Education Code, 3-19 as added by this Act, not later than January 1, 1994. 3-20 SECTION 5. The importance of this legislation and the 3-21 crowded condition of the calendars in both houses create an 3-22 emergency and an imperative public necessity that the 3-23 constitutional rule requiring bills to be read on three several 3-24 days in each house be suspended, and this rule is hereby suspended, 3-25 and that this Act take effect and be in force from and after its 3-26 passage, and it is so enacted.
