No. 220 73R1744 DLF-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to liability of health care clinics operated in 1-3 conjunction with approved family practice residency training 1-4 programs. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Subchapter I, Chapter 61, Education Code, is 1-7 amended by adding Section 61.506 to read as follows: 1-8 Sec. 61.506. LIABILITY. A clinic or other facility 1-9 providing health care in conjunction with an approved family 1-10 practice residency training program is a governmental unit subject 1-11 to Chapter 101, Civil Practice and Remedies Code, and the 1-12 limitation on the liability of the state government established 1-13 under Section 101.023(a), Civil Practice and Remedies Code, 1-14 applies. 1-15 SECTION 2. (a) This Act applies to all actions: 1-16 (1) commenced on or after the effective date of this 1-17 Act; or 1-18 (2) pending on that effective date and in which the 1-19 trial, or any new trial or retrial following motion, appeal, or 1-20 otherwise, begins on or after that effective date. 1-21 (b) In an action commenced before the effective date of this 1-22 Act, a trial, new trial, or retrial that is in progress on that 1-23 effective date is governed by the law in effect immediately before 1-24 that effective date, and that law is continued in effect for that 2-1 purpose. 2-2 SECTION 3. The importance of this legislation and the 2-3 crowded condition of the calendars in both houses create an 2-4 emergency and an imperative public necessity that the 2-5 constitutional rule requiring bills to be read on three several 2-6 days in each house be suspended, and this rule is hereby suspended, 2-7 and that this Act take effect and be in force from and after its 2-8 passage, and it is so enacted.
