S.B. No. 239 AN ACT 1-1 relating to funding for certain public institutions of higher 1-2 education. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subchapter C, Chapter 61, Education Code, is 1-5 amended by adding Section 61.0592 to read as follows: 1-6 Sec. 61.0592. FUNDING FOR CERTAIN FOUR-YEAR INSTITUTIONS. 1-7 (a) This section applies to Texas A&M University -- Corpus Christi 1-8 and The University of Texas of the Permian Basin. 1-9 (b) Notwithstanding Section 61.059 of this code, a formula 1-10 adopted by the board under that section that provides a 1-11 differential rate for each semester credit hour between four-year 1-12 general academic teaching institutions and upper-level institutions 1-13 shall be modified and applied as provided by this section to a 1-14 university to which this section applies. 1-15 (c) In addition to other funding that a university to which 1-16 this section applies is entitled to receive, the university is 1-17 entitled to receive additional funds in accordance with this 1-18 section. 1-19 (d) The formula for four-year general academic teaching 1-20 institutions shall be applied to all lower-division semester credit 1-21 hours at a university to which this section applies. 1-22 (e) For the first two state fiscal years that begin after a 1-23 university to which this section applies first admits 1-24 lower-division students or offers lower-division courses, the 2-1 formula for upper-level general academic teaching institutions 2-2 shall be applied to upper-division semester credit hours at the 2-3 university. 2-4 (f) Beginning with the third state fiscal year that begins 2-5 after a university to which this section applies first admits 2-6 lower-division students or offers lower-division courses, the 2-7 formula for four-year general academic teaching institutions shall 2-8 be applied to upper-division semester credit hours at the 2-9 university, except that the board shall modify the formula to 2-10 provide the university additional funding equal to a percent of the 2-11 difference between the amount derived from the application of the 2-12 four-year formula to the university's upper-division semester 2-13 credit hours and the amount derived from the application of the 2-14 upper-level formula to those semester credit hours. The percent to 2-15 be applied to that difference is 87.5 percent for the first fiscal 2-16 year to which this subsection applies and is reduced by 12.5 2-17 percentage points for each subsequent fiscal year. 2-18 SECTION 2. The importance of this legislation and the 2-19 crowded condition of the calendars in both houses create an 2-20 emergency and an imperative public necessity that the 2-21 constitutional rule requiring bills to be read on three several 2-22 days in each house be suspended, and this rule is hereby suspended, 2-23 and that this Act take effect and be in force from and after its 2-24 passage, and it is so enacted.
