No. 239 By: Montford 1-23 A BILL TO BE ENTITLED 1-24 AN ACT 1-25 relating to funding for certain public institutions of higher 1-26 education. 1-27 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-28 SECTION 1. Subchapter C, Chapter 61, Education Code, is 1-29 amended by adding Section 61.0592 to read as follows: 1-30 Sec. 61.0592. FUNDING FOR CERTAIN FOUR-YEAR INSTITUTIONS. 1-31 (a) This section applies to Texas A&M University at Corpus Christi 1-32 and The University of Texas of the Permian Basin. 1-33 (b) Notwithstanding Section 61.059 of this code, a formula 1-34 adopted by the board under that section that provides a 1-35 differential rate for each semester credit hour between four-year 1-36 general academic teaching institutions and upper-level institutions 1-37 shall be modified and applied as provided by this section to a 1-38 university to which this section applies. 1-39 (c) In addition to other funding that a university to which 1-40 this section applies is entitled to receive, the university is 1-41 entitled to receive additional funds in accordance with this 1-42 section. 1-43 (d) The formula for four-year general academic teaching 1-44 institutions shall be applied to all lower-division semester credit 1-45 hours at a university to which this section applies. 1-46 (e) For the first two state fiscal years that begin after a 1-47 university to which this section applies first admits 1-48 lower-division students or offers lower-division courses, the 1-49 formula for upper-level general academic teaching institutions 1-50 shall be applied to upper-division semester credit hours at the 1-51 university. 1-52 (f) Beginning with the third state fiscal year that begins 1-53 after a university to which this section applies first admits 1-54 lower-division students or offers lower-division courses, the 1-55 formula for four-year general academic teaching institutions shall 1-56 be applied to upper-division semester credit hours at the 1-57 university, except that the board shall modify the formula to 1-58 provide the university additional funding equal to a percent of the 1-59 difference between the amount derived from the application of the 1-60 four-year formula to the university's upper-division semester 1-61 credit hours and the amount derived from the application of the 1-62 upper-level formula to those semester credit hours. The percent to 1-63 be applied to that difference is 87.5 percent for the first fiscal 1-64 year to which this subsection applies and is reduced by 12.5 1-65 percentage points for each subsequent fiscal year. 1-66 SECTION 2. The importance of this legislation and the 1-67 crowded condition of the calendars in both houses create an 1-68 emergency and an imperative public necessity that the 2-1 constitutional rule requiring bills to be read on three several 2-2 days in each house be suspended, and this rule is hereby suspended, 2-3 and that this Act take effect and be in force from and after its 2-4 passage, and it is so enacted. 2-5 * * * * * 2-6 Austin, 2-7 Texas 2-8 March 3, 1993 2-9 Hon.
