76-17 ARTICLE III
76-18 SECTION 1. In this Act, "tract," "block numbering area
76-19 (BNA)," "block group," and "block" mean the geographic areas
76-20 identified by those terms in the Redistricting Map Data Base for
76-21 the State of Texas prepared by the Texas Legislative Council and
76-22 distributed by the council to the State Data Center, Texas
76-23 Department of Commerce, on March 22, 1991, for public distribution
76-24 by the State Data Center, which is a modified version of the P.L.
76-25 94-171 County Block Maps (1990) and the 1990 Census TIGER/Line File
76-26 prepared by the United States Department of Commerce Bureau of the
76-27 Census for the Twenty-first Decennial Census of the United States,
77-1 enumerated as of April 1, 1990.
77-2 SECTION 2. It is the intention of the Texas Legislature
77-3 that, if any county, tract, block numbering area, block group,
77-4 block, or other geographic area has erroneously been left out of
77-5 this Act, a court reviewing this Act should include that area in
77-6 the appropriate district in accordance with the intent of the
77-7 legislature, using any available evidence of that intent, including
77-8 but not limited to such evidence as that used by the Supreme Court
77-9 of Texas in Smith v. Patterson, 111 Tex. 535, 242 S.W. 749 (1922).
77-10 SECTION 3. This Act supersedes Chapter 1, Acts of the 72nd
77-11 Legislature, 3rd Called Session, 1992.
77-12 SECTION 4. This Act takes effect beginning with the election
77-13 of the 74th Legislature, but it does not affect the membership,
77-14 personnel, or districts of the 73rd Legislature. If a vacancy
77-15 occurs in the office of any member of the senate of the 73rd
77-16 Legislature and a special election to fill the vacancy is
77-17 necessary, the election shall be held in the district from which
77-18 the vacating member was elected.
77-19 SECTION 5. The importance of this legislation and the
77-20 crowded condition of the calendars in both houses create an
77-21 emergency and an imperative public necessity that the
77-22 constitutional rule requiring bills to be read on three several
77-23 days in each house be suspended, and this rule is hereby suspended,
77-24 and that this Act take effect and be in force from and after its
77-25 passage, and it is so enacted.
