S.B. No. 286 AN ACT 1-1 relating to the creation of the HIV/AIDS Interagency Coordinating 1-2 Council. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subchapter A, Chapter 85, Health and Safety Code, 1-5 is amended by adding Section 85.017 to read as follows: 1-6 Sec. 85.017. HIV/AIDS INTERAGENCY COORDINATING COUNCIL. 1-7 (a) The HIV/AIDS Interagency Coordinating Council is created to 1-8 facilitate communication between state agencies concerning HIV/AIDS 1-9 policies. 1-10 (b) The council consists of one representative from each of 1-11 the following agencies appointed by the executive director or 1-12 commissioner of each agency: 1-13 (1) the department; 1-14 (2) the Texas Department of Mental Health and Mental 1-15 Retardation; 1-16 (3) the Texas Department of Human Services; 1-17 (4) the Texas Commission on Alcohol and Drug Abuse; 1-18 (5) the Texas Rehabilitation Commission; 1-19 (6) the Texas Youth Commission; 1-20 (7) the Texas Department of Criminal Justice; 1-21 (8) the Texas Juvenile Probation Commission; 1-22 (9) the Texas Commission for the Blind; 1-23 (10) the Texas Commission for the Deaf and Hearing 2-1 Impaired; 2-2 (11) the Department of Protective and Regulatory 2-3 Services; 2-4 (12) the Central Education Agency; 2-5 (13) the Texas State Board of Medical Examiners; 2-6 (14) the Board of Nurse Examiners; 2-7 (15) the Board of Vocational Nurse Examiners; 2-8 (16) the Texas State Board of Dental Examiners; and 2-9 (17) the Health and Human Services Commission. 2-10 (c) All representatives appointed to the council must be 2-11 directly involved in policy or program activities related to AIDS 2-12 and HIV services for their respective agencies. 2-13 (d) The representative from the department serves as 2-14 chairperson of the council. 2-15 (e) The council shall meet at least once each quarter on 2-16 meeting dates set by the council. 2-17 (f) The council shall: 2-18 (1) coordinate communication among the member agencies 2-19 listed in Subsection (b) concerning each agency's programs in 2-20 providing AIDS-related and HIV-related services; 2-21 (2) develop a plan that facilitates coordination of 2-22 agency programs for prevention of AIDS and HIV infection and 2-23 provision of services to individuals with AIDS or infected with 2-24 HIV; and 2-25 (3) develop an annual report to be presented to the 3-1 legislature and the governor containing recommendations and plans 3-2 for coordinated activities that address issues and problems 3-3 involved in AIDS and HIV infection prevention and delivery of 3-4 health services to individuals with AIDS or infected with HIV. 3-5 (g) The council shall establish advisory committees composed 3-6 of representatives from associations, consumer advocates, and 3-7 regulatory agencies, boards, or commissions as needed to assist in 3-8 carrying out its duties under this section. 3-9 (h) The department shall provide administrative support to 3-10 the council. 3-11 SECTION 2. Section 85.003, Health and Safety Code, is 3-12 amended to read as follows: 3-13 Sec. 85.003. DEPARTMENT AS LEAD AGENCY AND PRIMARY RESOURCE. 3-14 The department, in the discharge of its duty to protect the public 3-15 health, shall act as the lead agency for AIDS and HIV policy for 3-16 Texas and is the primary resource for HIV education, prevention, 3-17 risk reduction materials, policies, and information in this state. 3-18 SECTION 3. This Act takes effect September 1, 1993. 3-19 SECTION 4. The importance of this legislation and the 3-20 crowded condition of the calendars in both houses create an 3-21 emergency and an imperative public necessity that the 3-22 constitutional rule requiring bills to be read on three several 3-23 days in each house be suspended, and this rule is hereby suspended.
