                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the creation of the HIV/AIDS Interagency Coordinating
    1-2  Council.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter A, Chapter 85, Health and Safety Code,
    1-5  is amended by adding Section 85.017 to read as follows:
    1-6        Sec.  85.017.  HIV/AIDS INTERAGENCY COORDINATING COUNCIL.
    1-7  (a)  The HIV/AIDS Interagency Coordinating Council is created to
    1-8  facilitate communication between state agencies concerning HIV/AIDS
    1-9  policies.
   1-10        (b)  The council consists of one representative from each of
   1-11  the following agencies appointed by the executive director or
   1-12  commissioner of each agency:
   1-13              (1)  the department;
   1-14              (2)  the Texas Department of Mental Health and Mental
   1-15  Retardation;
   1-16              (3)  the Texas Department of Human Services;
   1-17              (4)  the Texas Commission on Alcohol and Drug Abuse;
   1-18              (5)  the Texas Rehabilitation Commission;
   1-19              (6)  the Texas Youth Commission;
   1-20              (7)  the Texas Department of Criminal Justice;
   1-21              (8)  the Texas Juvenile Probation Commission;
   1-22              (9)  the Texas Commission for the Blind;
   1-23              (10)  the Texas Commission for the Deaf and Hearing
    2-1  Impaired;
    2-2              (11)  the Department of Protective and Regulatory
    2-3  Services;
    2-4              (12)  the Central Education Agency;
    2-5              (13)  the Texas State Board of Medical Examiners;
    2-6              (14)  the Board of Nurse Examiners;
    2-7              (15)  the Board of Vocational Nurse Examiners; and
    2-8              (16)  the Texas State Board of Dental Examiners.
    2-9        (c)  All representatives appointed to the council must be
   2-10  directly involved in policy or program activities related to AIDS
   2-11  and HIV services for their respective agencies.
   2-12        (d)  The representative from the department serves as
   2-13  chairperson of the council.
   2-14        (e)  The council shall meet at least once each quarter on
   2-15  meeting dates set by the council.
   2-16        (f)  The council shall:
   2-17              (1)  coordinate communication among the member agencies
   2-18  listed in Subsection (b) concerning each agency's programs in
   2-19  providing AIDS-related and HIV-related services;
   2-20              (2)  develop a plan that facilitates coordination of
   2-21  agency programs for prevention of AIDS and HIV infection and
   2-22  provision of services to individuals with AIDS or infected with
   2-23  HIV; and
   2-24              (3)  develop an annual report to be presented to the
   2-25  legislature and the governor containing recommendations and plans
    3-1  for coordinated activities that address issues and problems
    3-2  involved in AIDS and HIV infection prevention and delivery of
    3-3  health services to individuals with AIDS or infected with HIV.
    3-4        (g)  The council shall establish advisory committees composed
    3-5  of representatives from associations, consumer advocates, and
    3-6  regulatory agencies, boards, or commissions as needed to assist in
    3-7  carrying out its duties under this section.
    3-8        (h)  The department shall provide administrative support to
    3-9  the council.
   3-10        SECTION 2.  Section 85.003, Health and Safety Code, is
   3-11  amended to read as follows:
   3-12        Sec. 85.003.  DEPARTMENT AS LEAD AGENCY AND PRIMARY RESOURCE.
   3-13  The department, in the discharge of its duty to protect the public
   3-14  health, shall act as the lead agency for AIDS and HIV policy for
   3-15  Texas and is the primary resource for HIV education, prevention,
   3-16  risk reduction materials, policies, and information in this state.
   3-17        SECTION 3.  This Act takes effect September 1, 1993.
   3-18        SECTION 4.  The importance of this legislation and the
   3-19  crowded condition of the calendars in both houses create an
   3-20  emergency and an imperative public necessity that the
   3-21  constitutional rule requiring bills to be read on three several
   3-22  days in each house be suspended, and this rule is hereby suspended.
