1-19 On page 1, after line 54 add a new subsection to Section 85.017(b)

1-22 A BILL TO BE ENTITLED
1-23 AN ACT
1-24 relating to the creation of the HIV/AIDS Interagency Coordinating
1-25 Council.
1-26 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-27 SECTION 1. Subchapter A, Chapter 85, Health and Safety Code,
1-28 is amended by adding Section 85.017 to read as follows:
1-29 Sec. 85.017. HIV/AIDS INTERAGENCY COORDINATING COUNCIL.
1-30 (a) The HIV/AIDS Interagency Coordinating Council is created to
1-31 facilitate communication between state agencies concerning HIV/AIDS
1-32 policies.
1-33 (b) The council consists of one representative from each of
1-34 the following agencies appointed by the executive director or
1-35 commissioner of each agency:
1-36 (1) the department;
1-37 (2) the Texas Department of Mental Health and Mental
1-38 Retardation;
1-39 (3) the Texas Department of Human Services;
1-40 (4) the Texas Commission on Alcohol and Drug Abuse;
1-41 (5) the Texas Rehabilitation Commission;
1-42 (6) the Texas Youth Commission;
1-43 (7) the Texas Department of Criminal Justice;
1-44 (8) the Texas Juvenile Probation Commission;
1-45 (9) the Texas Commission for the Blind;
1-46 (10) the Texas Commission for the Deaf and Hearing
1-47 Impaired;
1-48 (11) the Department of Protective and Regulatory
1-49 Services;
1-50 (12) the Central Education Agency;
1-51 (13) the Texas State Board of Medical Examiners;
1-52 (14) the Board of Nurse Examiners;
1-53 (15) the Board of Vocational Nurse Examiners; and
1-54 (16) the Texas State Board of Dental Examiners.
1-55 (c) All representatives appointed to the council must be
1-56 directly involved in policy or program activities related to AIDS
1-57 and HIV services for their respective agencies.
1-58 (d) The representative from the department serves as
1-59 chairperson of the council.
1-60 (e) The council shall meet at least once each quarter on
1-61 meeting dates set by the council.
1-62 (f) The council shall:
1-63 (1) coordinate communication among the member agencies
1-64 listed in Subsection (b) concerning each agency's programs in
1-65 providing AIDS-related and HIV-related services;
1-66 (2) develop a plan that facilitates coordination of
1-67 agency programs for prevention of AIDS and HIV infection and
1-68 provision of services to individuals with AIDS or infected with
2-1 HIV; and
2-2 (3) develop an annual report to be presented to the
2-3 legislature and the governor containing recommendations and plans
2-4 for coordinated activities that address issues and problems
2-5 involved in AIDS and HIV infection prevention and delivery of
2-6 health services to individuals with AIDS or infected with HIV.
2-7 (g) The council shall establish advisory committees composed
2-8 of representatives from associations, consumer advocates, and
2-9 regulatory agencies, boards, or commissions as needed to assist in
2-10 carrying out its duties under this section.
2-11 (h) The department shall provide administrative support to
2-12 the council.
2-13 SECTION 2. Section 85.003, Health and Safety Code, is
2-14 amended to read as follows:
2-15 Sec. 85.003. DEPARTMENT AS LEAD AGENCY AND PRIMARY RESOURCE.
2-16 The department, in the discharge of its duty to protect the public
2-17 health, shall act as the lead agency for AIDS and HIV policy for
2-18 Texas and is the primary resource for HIV education, prevention,
2-19 risk reduction materials, policies, and information in this state.
2-20 SECTION 3. This Act takes effect September 1, 1993.
2-21 SECTION 4. The importance of this legislation and the
2-22 crowded condition of the calendars in both houses create an
2-23 emergency and an imperative public necessity that the
2-24 constitutional rule requiring bills to be read on three several
2-25 days in each house be suspended, and this rule is hereby suspended.
