                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to eligibility for service retirement of members of the
    1-3  elected class of the Employees Retirement System of Texas.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 814.102, Government Code, is amended to
    1-6  read as follows:
    1-7        Sec. 814.102.  ELIGIBILITY OF ELECTED MEMBERS FOR SERVICE
    1-8  RETIREMENT.  Except as provided by rule adopted under Section
    1-9  813.304(d) or Section 803.202(2), a member who has service credit
   1-10  in the elected class of membership<,> is eligible to retire and
   1-11  receive a service retirement annuity if the member:
   1-12              (1)  is at least 60 years old and has 10 <8> years of
   1-13  service credit in the retirement system <that class>; or
   1-14              (2)  is at least 55 <50> years old and has 12 years of
   1-15  service credit in the retirement system <that class>.
   1-16        SECTION 2.  This Act takes effect September 1, 1993.
   1-17        SECTION 3.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency   and   an   imperative   public   necessity   that   the
   1-20  constitutional rule requiring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended.
