   1-21        Amend S.B. No. 335 in SECTION 1, Section 54.516(a), Education
   1-22  Code (page 1, lines 41-43), by striking "the student government at
   1-23  the university or, if no student government exists at the
   1-24  university, a majority vote of".
   1-25                         A BILL TO BE ENTITLED
   1-26                                AN ACT
   1-27  relating to student union fees at East Texas State University.
   1-28        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-29        SECTION 1.  Subsections (a) and (b), Section 54.516,
   1-30  Education Code, are amended to read as follows:
   1-31        (a)  The board of regents of East Texas State University may
   1-32  levy a regular fixed student fee not to exceed $40 <$15> per
   1-33  student for each semester of the long session and not to exceed $20
   1-34  <$7.50> per student for each term of the summer school, or any
   1-35  fractional part thereof, as may in their discretion be just and
   1-36  necessary for the sole purpose of financing, constructing,
   1-37  operating, maintaining, and improving the Union Center Building.
   1-38  The amount of the fee may be changed at any time within the limits
   1-39  specified in order that sufficient funds to support the Union
   1-40  Center Building may be raised, but any increase in the fee must be
   1-41  approved by a majority vote of the student government at the
   1-42  university or, if no student government exists at the university, a
   1-43  majority vote of those students participating in a general election
   1-44  called for that purpose.  The fees herein authorized to be levied
   1-45  should be in addition to any use fee and service fee now or
   1-46  hereafter levied in accordance with law.  No state funds may be
   1-47  expended for use of the Union Center Building.
   1-48        (b)  The fiscal officer <business manager> of East Texas
   1-49  State University shall collect the fees provided for in this
   1-50  section and shall credit the money received from the fees to an
   1-51  account known as the Union Center Building Account.
   1-52        SECTION 2.  Section 54.516, Education Code, as amended by
   1-53  this Act, applies only to student union fees at East Texas State
   1-54  University that become due beginning with the fall semester in
   1-55  1993.  Student union fees that became due before that semester are
   1-56  governed by the law in effect at the time those fees became due,
   1-57  and that law is continued in effect for this purpose only.
   1-58        SECTION 3.  The importance of this legislation and the
   1-59  crowded condition of the calendars in both houses create an
   1-60  emergency and an imperative public necessity that the
   1-61  constitutional rule requiring bills to be read on three several
   1-62  days in each house be suspended, and this rule is hereby suspended,
   1-63  and that this Act take effect and be in force from and after its
   1-64  passage, and it is so enacted.
