1-21 A BILL TO BE ENTITLED
1-22 AN ACT
1-23 relating to retaining the current names of the Texas Department of
1-24 Health and the Texas Board of Health.
1-25 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-26 SECTION 1. The heading to Article 4413(504), Revised
1-27 Statutes, is amended to read as follows:
1-28 Art. 4413(504). TEXAS DEPARTMENT OF <PUBLIC> HEALTH
1-29 SECTION 2. Sections 1 and 2, Article 4413(504), Revised
1-30 Statutes, are amended to read as follows:
1-31 Sec. 1. DEFINITIONS. In this article:
1-32 (1) "Board" means the Texas Board of <Public> Health.
1-33 (2) "Commission" means the Health and Human Services
1-34 Commission.
1-35 (3) "Department" means the Texas Department of
1-36 <Public> Health.
1-37 (4) "Director" means the director of the Texas
1-38 Department of <Public> Health.
1-39 Sec. 2. COMPOSITION AND RESPONSIBILITY OF DEPARTMENT. The
1-40 Texas Department of <Public> Health is composed of the board, the
1-41 director, and administrative staff, and other officers and
1-42 employees necessary to efficiently carry out the purposes of this
1-43 article. The department is the state agency with primary
1-44 responsibility for providing health services, including:
1-45 (1) disease prevention;
1-46 (2) health promotion;
1-47 (3) indigent health care;
1-48 (4) certain acute care services; and
1-49 (5) other health-related services as provided by law.
1-50 SECTION 3. Subdivision (3), Section 2, Texas Nursing Home
1-51 Administrators Licensure Act (Article 4442d, Vernon's Texas Civil
1-52 Statutes), is amended to read as follows:
1-53 (3) "nursing home" means any institution or facility
1-54 <now or hereafter> licensed as a "nursing home" or "custodial care
1-55 home" <by the Texas State Department of Public Health> under the
1-56 provisions of Chapter 242, Health and Safety Code;
1-57 SECTION 4. Subsection (c), Section 3, Chapter 65, Acts of
1-58 the 41st Legislature, 1st Called Session, 1929 (Article 8407a,
1-59 Vernon's Texas Civil Statutes), is amended to read as follows:
1-60 (c) The board shall issue a barber shop permit to an
1-61 applicant who holds a valid class A barber license and whose shop
1-62 meets the minimum health standards for barber shops as promulgated
1-63 by the Texas <State> Department of <Public> Health and all rules
1-64 and regulations of the board.
1-65 SECTION 5. Any transfer to the Department of Public Health
1-66 provided by Chapter 15, Acts of the 72nd Legislature, 1st Called
1-67 Session, 1991, means a transfer to the entity created by Article
1-68 4413(504), Revised Statutes, and renamed the Texas Department of
2-1 Health by this Act.
2-2 SECTION 6. This Act takes effect September 1, 1993.
2-3 SECTION 7. The importance of this legislation and the
2-4 crowded condition of the calendars in both houses create an
2-5 emergency and an imperative public necessity that the
2-6 constitutional rule requiring bills to be read on three several
2-7 days in each house be suspended, and this rule is hereby suspended.
