1-21 A BILL TO BE ENTITLED
1-22 AN ACT
1-23 relating to the requirements for the licensing of public employees
1-24 who perform pest control services.
1-25 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-26 SECTION 1. Subsection (b), Section 4B, Texas Structural Pest
1-27 Control Act (Article 135b-6, Vernon's Texas Civil Statutes), is
1-28 amended to read as follows:
1-29 (b) An individual must be licensed as a certified
1-30 noncommercial applicator if the individual is not licensed as a
1-31 certified commercial applicator and the individual:
1-32 (1) is an employee of the state or a city or county
1-33 not excepted from the licensing provisions of this Act under
1-34 Section 5(b) or Section 11 of this Act who <and> engages in the
1-35 business of structural pest control; or
1-36 (2) is an employee of a person who owns, operates, or
1-37 maintains a building, the individual engages in the business of
1-38 structural pest control in the building, and the building is an
1-39 apartment building; day-care center; hospital; nursing home; hotel;
1-40 motel; lodge; warehouse; food-processing establishment, other than
1-41 a restaurant, retail food, or food service establishment; school or
1-42 educational institution.
1-43 SECTION 2. The importance of this legislation and the
1-44 crowded condition of the calendars in both houses create an
1-45 emergency and an imperative public necessity that the
1-46 constitutional rule requiring bills to be read on three several
1-47 days in each house be suspended, and this rule is hereby suspended.
