1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to the expansion of the Communities in Schools program.
1-22 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-23 SECTION 1. Subsections (e) and (f), Section 11-D, Texas
1-24 Unemployment Compensation Act (Article 5221b-9d, Vernon's Texas
1-25 Civil Statutes), are amended to read as follows:
1-26 (e) An elementary or secondary school shall participate in
1-27 the program if the number of students enrolled in the school who
1-28 are at risk of dropping out of school is equal to at least 10
1-29 percent of the number of students in average daily attendance at
1-30 the school, as determined by the Central Education Agency, and the
1-31 school is:
1-32 (1) located in a county or city in which the program
1-33 is established on September 1, 1993 <1991>, and is designated to
1-34 participate in the program under Subsection (f) of this article; or
1-35 (2) located in one of six <four> additional counties
1-36 or cities designated by the state coordinator.
1-37 (f) The state coordinator in cooperation with the program
1-38 directors in the counties or cities in which the program is
1-39 established on September 1, 1993 <1991>, shall designate the
1-40 original campuses for continuance in the program and designate not
1-41 more than 135 additional <32> elementary <schools> and <76>
1-42 secondary schools in those counties or cities to participate in the
1-43 program. The state coordinator in cooperation with the program
1-44 directors in the six <four> additional counties or cities
1-45 designated by the state coordinator shall designate additional
1-46 elementary and secondary schools to participate in the program.
1-47 Secondary school programs must be distributed among high schools
1-48 and junior high or middle schools.
1-49 SECTION 2. (a) This Act takes effect September 1, 1993.
1-50 (b) Each elementary and secondary school designated to begin
1-51 participation in the Communities in Schools program under
1-52 Subsection (f), Section 11-D, Texas Unemployment Compensation Act
1-53 (Article 5221b-9d, Vernon's Texas Civil Statutes), as amended by
1-54 this Act, shall begin participation in the program not later than
1-55 September 1, 1995. The state coordinator shall designate six
1-56 additional counties or cities for participation in the program
1-57 under Subsection (e), Section 11-D, Texas Unemployment Compensation
1-58 Act (Article 5221b-9d, Vernon's Texas Civil Statutes), as amended
1-59 by this Act, not later than September 1, 1995.
1-60 (c) This Act will not require an appropriation in excess of
1-61 the Communities in Schools program's current level of general
1-62 revenue funding unless new revenue measures are implemented to
1-63 provide a state budget surplus sufficient to fund the expansion of
1-64 Communities in Schools. If no surplus general revenue is
1-65 available, funding for expansion of Communities in Schools programs
1-66 as provided in this Act shall be accomplished by setting aside
1-67 $10.7 million in the first year and $14.8 million in the second
1-68 year of the biennium from funds allocated under Section 16.152,
2-1 Education Code.
2-2 SECTION 3. The importance of this legislation and the
2-3 crowded condition of the calendars in both houses create an
2-4 emergency and an imperative public necessity that the
2-5 constitutional rule requiring bills to be read on three several
2-6 days in each house be suspended, and this rule is hereby suspended.
