1-21 A BILL TO BE ENTITLED
1-22 AN ACT
1-23 relating to county purchase of road construction material.
1-24 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-25 SECTION 1. Section 262.027, Local Government Code, is
1-26 amended by amending Subsection (a) and adding Subsection (e) to
1-27 read as follows:
1-28 (a) The officer in charge of opening the bids shall present
1-29 them to the commissioners court in session. Except as provided by
1-30 Subsection (e), the <The> court shall:
1-31 (1) award the contract to the responsible bidder who
1-32 submits the lowest and best bid; or
1-33 (2) reject all bids and publish a new notice.
1-34 (e) In determining the lowest and best bid for a contract
1-35 for the purchase of road construction material, the commissioners
1-36 court may consider the pickup and delivery locations of the bidders
1-37 and the cost to the county of delivering or hauling the material to
1-38 be purchased. The commissioners court may award contracts for the
1-39 purchase of road construction material to more than one bidder if
1-40 each of the selected bidders submits the lowest and best bid for a
1-41 particular location or type of material.
1-42 SECTION 2. The importance of this legislation and the
1-43 crowded condition of the calendars in both houses create an
1-44 emergency and an imperative public necessity that the
1-45 constitutional rule requiring bills to be read on three several
1-46 days in each house be suspended, and this rule is hereby suspended,
1-47 and that this Act take effect and be in force from and after its
1-48 passage, and it is so enacted.
