                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to fees for issuance of certain certificates issued by the
    1-3  Texas Department of Health; making an appropriation.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 431.241(f), Health and Safety Code, is
    1-6  amended and redesignated as  Subsections (f) and (g) to read as
    1-7  follows:
    1-8        (f)  The department may assess a fee for the issuance of a
    1-9  certificate of free sale and another certification issued under
   1-10  this chapter.  The board by rule shall set each fee in an amount
   1-11  sufficient to recover the cost to the department of issuing the
   1-12  particular certificate.
   1-13        (g)  Nothing in this section shall effect a prior approval
   1-14  program in operation on the effective date of this section nor
   1-15  shall any portion of this chapter prohibit a prior approval process
   1-16  on any federally exempted products.
   1-17        SECTION 2.  There is appropriated to the Texas Department of
   1-18  Health from the general revenue fund for the fiscal biennium ending
   1-19  August 31, 1995, the revenue from the fees collected by the
   1-20  department under Section 431.241(f), Health and Safety Code, as
   1-21  added by this Act, to be used to administer that provision.
   1-22        SECTION 3.  This Act takes effect September 1, 1993.
   1-23        SECTION 4.  The importance of this legislation and the
   1-24  crowded condition of the calendars in both houses create an
    2-1  emergency   and   an   imperative   public   necessity   that   the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended.
