Chapter 52, Family Code, is amended by adding 1-31 Section 52.026 to read as follows: 1-32 Sec. 52.026. RESPONSIBILITY FOR TRANSPORTING JUVENILE 1-33 OFFENDERS. (a) It shall be the duty of the law enforcement 1-34 officer who has taken a child into custody to transport the child 1-35 to the appropriate juvenile detention facility if the child is not 1-36 released to the parent, guardian, or custodian of the child. 1-37 (b) If the juvenile detention facility is located outside 1-38 the county in which the child is taken into custody, it shall be 1-39 the duty of the sheriff of that county to transport the child to 1-40 the appropriate juvenile detention facility if the child is not 1-41 released to the parent, guardian, or custodian of the child. 1-42 (c) At the request of the juvenile probation department, it 1-43 shall be the duty of the sheriff of the county in which the child 1-44 is taken into custody to transport the child to and from all 1-45 scheduled juvenile court proceedings and appearances and other 1-46 activities ordered by the juvenile court. 1-47 SECTION 2. The importance of this legislation and the 1-48 crowded condition of the calendars in both houses create an 1-49 emergency and an imperative public necessity that the 1-50 constitutional rule requiring bills to be read on three several 1-51 days in each house be suspended, and this rule is hereby suspended, 1-52 and that this Act take effect and be in force from and after its 1-53 passage, and it is so enacted. 1-54 * * * * * 1-55 Austin, 1-56 Texas 1-57 April 15, 1993 1-58 Hon.
