1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to notification by school districts to parents concerning
1-22 a teacher teaching a subject the teacher is not certified to teach.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Subsection (c), Section 11.26, Education Code, is
1-25 amended to read as follows:
1-26 (c) With the advice and assistance of the state commissioner
1-27 of education, the State Board of Education shall:
1-28 (1) make to the legislature biennial reports covering
1-29 all the activities and expenditures of the Central Education
1-30 Agency;
1-31 (2) adopt rules for the accreditation of schools;
1-32 (3) execute contracts for the purchase of
1-33 instructional aids, including textbooks, within the limits of
1-34 authority granted by the legislature;
1-35 (4) execute contracts for the investment of the
1-36 permanent school fund, within the limits of authority granted by
1-37 Chapter 15 of this code;
1-38 (5) adopt rules consistent with Chapter 13 of this
1-39 code for certification of teachers, administrators, and other
1-40 professional personnel customarily employed in public schools;
1-41 (6) adopt rules requiring school districts to notify
1-42 parents of students of a teacher teaching a subject for which the
1-43 teacher is not certified, unless the teacher is serving an
1-44 internship under Section 13.035 of this code<,> or the teacher has
1-45 at least 24 semester credit hours in the subject<, or the teacher
1-46 is teaching under an emergency permit and is making satisfactory
1-47 progress toward completion of a deficiency plan>;
1-48 (7) consider the athletic necessities and activities
1-49 of the public schools of Texas and in advance of each regular
1-50 session of the legislature specifically report to the governor of
1-51 Texas the proper and lawful division of time and money to be
1-52 devoted to athletics, holidays, legal and otherwise, and to
1-53 educational purposes; and
1-54 (8) on or before May 15 of each year, formulate and
1-55 transmit to the Texas Council on Vocational Education a list of
1-56 evaluation topics that address developing and future concerns of
1-57 the board in the field of technical-vocational education.
1-58 SECTION 2. This Act applies beginning with the 1993-1994
1-59 school year.
1-60 SECTION 3. The importance of this legislation and the
1-61 crowded condition of the calendars in both houses create an
1-62 emergency and an imperative public necessity that the
1-63 constitutional rule requiring bills to be read on three several
1-64 days in each house be suspended, and this rule is hereby suspended,
1-65 and that this Act take effect and be in force from and after its
1-66 passage, and it is so enacted.
