No. 615 A BILL TO BE ENTITLED AN ACT 1-1 relating to a recreational facility fee at The University of Texas 1-2 at El Paso. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subchapter E, Chapter 54, Education Code, is 1-5 amended by adding Section 54.541 to read as follows: 1-6 Sec. 54.541. RECREATIONAL FACILITY FEE; THE UNIVERSITY OF 1-7 TEXAS AT EL PASO. (a) The board of regents of The University of 1-8 Texas System may charge each student enrolled at The University of 1-9 Texas at El Paso a recreational facility fee not to exceed $12 per 1-10 student per semester or summer session. The fee may be used only 1-11 for financing, constructing, operating, maintaining, and improving 1-12 new and existing recreational sports facilities and programs at The 1-13 University of Texas at El Paso. 1-14 (b) The board of regents is authorized to pledge the fees 1-15 levied under this section for the payment of obligations issued for 1-16 authorized purposes pursuant to the revenue financing system of The 1-17 University of Texas System. 1-18 (c) The recreational facility fee may not be levied unless 1-19 the fee is approved and the amount of the fee is set by majority 1-20 vote of those students participating in a general student election 1-21 called at The University of Texas at El Paso for that purpose. 1-22 (d) The University of Texas at El Paso shall collect the 1-23 recreational facility fee and deposit the money collected in an 2-1 account to be known as The University of Texas at El Paso 2-2 recreational facility account. 2-3 (e) The recreational facility fee is not counted in 2-4 determining the maximum amount of student services fees which may 2-5 be charged under Section 54.503 of this code, as amended. 2-6 SECTION 2. Section 54.541, Education Code, as added by this 2-7 Act, applies beginning with the fall semester in 1993. 2-8 SECTION 3. All recreational facilities fees approved by a 2-9 majority vote of those students participating in a general student 2-10 election called at The University of Texas at El Paso for that 2-11 purpose before the effective date of this Act are validated, 2-12 ratified, and confirmed as they were adopted in compliance with 2-13 this Act. 2-14 SECTION 4. The importance of this legislation and the 2-15 crowded condition of the calendars in both houses create an 2-16 emergency and an imperative public necessity that the 2-17 constitutional rule requiring bills to be read on three several 2-18 days in each house be suspended, and this rule is hereby suspended, 2-19 and that this Act take effect and be in force from and after its 2-20 passage, and it is so enacted.
