1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to a recreational facility fee at The University of Texas
1-22 at El Paso.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Subchapter E, Chapter 54, Education Code, is
1-25 amended by adding Section 54.541 to read as follows:
1-26 Sec. 54.541. RECREATIONAL FACILITY FEE; THE UNIVERSITY OF
1-27 TEXAS AT EL PASO. (a) The board of regents of The University of
1-28 Texas System may charge each student enrolled at The University of
1-29 Texas at El Paso a recreational facility fee not to exceed $12 per
1-30 student per semester or summer session. The fee may be used only
1-31 for financing, constructing, operating, maintaining, and improving
1-32 new and existing recreational sports facilities and programs at The
1-33 University of Texas at El Paso.
1-34 (b) The board of regents is authorized to pledge the fees
1-35 levied under this section for the payment of obligations issued for
1-36 authorized purposes pursuant to the revenue financing system of The
1-37 University of Texas System.
1-38 (c) The recreational facility fee may not be levied unless
1-39 the fee is approved and the amount of the fee is set by majority
1-40 vote of those students participating in a general student election
1-41 called at The University of Texas at El Paso for that purpose.
1-42 (d) The University of Texas at El Paso shall collect the
1-43 recreational facility fee and deposit the money collected in an
1-44 account to be known as The University of Texas at El Paso
1-45 recreational facility account.
1-46 (e) The recreational facility fee is not counted in
1-47 determining the maximum amount of student services fees which may
1-48 be charged under Section 54.503 of this code, as amended.
1-49 SECTION 2. Section 54.541, Education Code, as added by this
1-50 Act, applies beginning with the fall semester in 1993.
1-51 SECTION 3. All recreational facilities fees approved by a
1-52 majority vote of those students participating in a general student
1-53 election called at The University of Texas at El Paso for that
1-54 purpose before the effective date of this Act are validated,
1-55 ratified, and confirmed as they were adopted in compliance with
1-56 this Act.
1-57 SECTION 4. The importance of this legislation and the
1-58 crowded condition of the calendars in both houses create an
1-59 emergency and an imperative public necessity that the
1-60 constitutional rule requiring bills to be read on three several
1-61 days in each house be suspended, and this rule is hereby suspended,
1-62 and that this Act take effect and be in force from and after its
1-63 passage, and it is so enacted.
