                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the collection of medical services fees by certain
    1-2  public institutions of higher education.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter E, Chapter 54, Education Code, is
    1-5  amended by adding Section 54.5075 to read as follows:
    1-6        Sec. 54.5075.  MEDICAL SERVICES FEE; THE TEXAS A&M UNIVERSITY
    1-7  SYSTEM.  (a)  The board of regents of The Texas A&M University
    1-8  System may charge each student registered at a component
    1-9  institution of The Texas A&M University System a medical services
   1-10  fee not to exceed $55 for each semester of the regular term or
   1-11  12-week summer session and not to exceed $25 for each six-week or
   1-12  shorter term of the summer session.
   1-13        (b)  Before charging a medical services fee, the board must
   1-14  give students and administrators of the component institution at
   1-15  which the medical services fee is to be charged an opportunity to
   1-16  offer recommendations to the board as to the type and scope of
   1-17  medical services that should be provided.
   1-18        (c)  A medical services fee charged at a component
   1-19  institution of The Texas A&M University System may be used only to
   1-20  provide medical services to students registered at that component
   1-21  institution.
   1-22        (d)  A medical services fee charged under this section is in
   1-23  addition to any other fee the board is authorized by law to charge
   1-24  and may not be considered in determining the maximum student
    2-1  services fee that may be charged to students enrolled at a
    2-2  component institution of The Texas A&M University System under
    2-3  Section 54.503(b) of this code.
    2-4        SECTION 2.  Subchapter E, Chapter 54, Education Code, is
    2-5  amended by adding Section 54.5089 to read as follows:
    2-6        Sec. 54.5089.  MEDICAL SERVICES FEE; TEXAS STATE UNIVERSITY
    2-7  SYSTEM COMPONENTS.  (a)  The board of regents of the Texas State
    2-8  University System may charge each student registered at a component
    2-9  institution of the Texas State University System a medical services
   2-10  fee not to exceed $55 for each semester of the regular term or
   2-11  12-week summer session and not to exceed $25 for each six-week or
   2-12  shorter term of the summer session.
   2-13        (b)  Before charging a medical services fee, the board must
   2-14  give students and administrators an opportunity to offer
   2-15  recommendations to the board as to the type and scope of medical
   2-16  services that should be provided.
   2-17        (c)  A medical services fee charged at a component
   2-18  institution of the Texas State University System may be used only
   2-19  to provide medical services to students registered at that
   2-20  component institution.
   2-21        (d)  A medical services fee charged under this section is in
   2-22  addition to any other fee the board is authorized by law to charge
   2-23  and may not be considered in determining the maximum student
   2-24  services fee that may be charged students enrolled at a component
   2-25  institution of the Texas State University System under Section
   2-26  54.503(b) of this code.
   2-27        SECTION 3.  Subchapter E, Chapter 54, Education Code, is
    3-1  amended by adding Section 54.50891 to read as follows:
    3-2        Sec. 54.50891.  MEDICAL SERVICES FEE; THE UNIVERSITY OF TEXAS
    3-3  SYSTEM COMPONENTS.  (a)  The board of regents of The University of
    3-4  Texas System may charge each student registered at a component
    3-5  institution of The University of Texas System a medical services
    3-6  fee not to exceed $55 for each semester of the regular term or
    3-7  12-week summer session and not to exceed $25 for each six-week or
    3-8  shorter term of the summer session.
    3-9        (b)  Before charging a medical services fee, the board must
   3-10  give students and administrators an opportunity to offer
   3-11  recommendations to the board as to the type and scope of medical
   3-12  services that should be provided.
   3-13        (c)  A medical services fee charged at a component
   3-14  institution of The University of Texas System may be used only to
   3-15  provide medical services to students registered at that component
   3-16  institution.
   3-17        (d)  A medical services fee charged under this section is in
   3-18  addition to any other fee the board is authorized by law to charge
   3-19  and may not be considered in determining the maximum student
   3-20  services fee that may be charged students enrolled at a component
   3-21  institution of The University of Texas System.
   3-22        SECTION 4.  Sections 54.5075, 54.5089, and 54.50891,
   3-23  Education Code, as added by this Act, apply beginning with the fall
   3-24  semester 1993.
   3-25        SECTION 5.  The importance of this legislation and the
   3-26  crowded condition of the calendars in both houses create an
   3-27  emergency and an imperative public necessity that the
    4-1  constitutional rule requiring bills to be read on three several
    4-2  days in each house be suspended, and this rule is hereby suspended,
    4-3  and that this Act take effect and be in force from and after its
    4-4  passage, and it is so enacted.
