S.B. No. 637 AN ACT 1-1 relating to the collection of medical services fees by certain 1-2 public institutions of higher education. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Section 54.507, Education Code, is amended to 1-5 read as follows: 1-6 Sec. 54.507. GROUP HOSPITAL AND MEDICAL SERVICES FEES; TEXAS 1-7 A&M UNIVERSITY SYSTEM. (a) The Board of Regents of The Texas A&M 1-8 University System may levy and collect from each student at any 1-9 institution of higher education which is a part of The Texas A&M 1-10 University System a compulsory group hospital and medical services 1-11 fee of not to exceed $25 for each regular semester and not to 1-12 exceed $12.50 for each term of each summer session. The compulsory 1-13 group hospital and medical services fee may not be levied unless 1-14 the levy of the fee has been approved by a majority vote of those 1-15 students at the affected institution participating in a general 1-16 student election called for that purpose. 1-17 (b) In addition to the fee authorized under Subsection (a) 1-18 of this section, the Board of Regents of The Texas A&M University 1-19 System may levy and collect from each student registered at Prairie 1-20 View A&M University a supplemental group hospital and medical 1-21 services fee not to exceed $30 for each regular semester and not to 1-22 exceed $12.50 for each term of the summer session. The 1-23 supplemental group hospital and medical services fee may not be 1-24 levied unless the levy of the fee has been approved by a majority 2-1 vote of the students registered at Prairie View A&M University 2-2 participating in a general election called for that purpose. 2-3 (c) A fee levied under this section at a component 2-4 institution of The Texas A&M University System may be used only to 2-5 provide hospital or other medical services to students registered 2-6 at that component institution. 2-7 SECTION 2. Subchapter E, Chapter 54, Education Code, is 2-8 amended by adding Section 54.5089 to read as follows: 2-9 Sec. 54.5089. MEDICAL SERVICES FEE; TEXAS STATE UNIVERSITY 2-10 SYSTEM COMPONENTS. (a) The board of regents of the Texas State 2-11 University System may charge each student registered at a component 2-12 institution of the Texas State University System a medical services 2-13 fee not to exceed $55 for each semester of the regular term or 2-14 12-week summer session and not to exceed $25 for each six-week or 2-15 shorter term of the summer session. 2-16 (b) Before charging a medical services fee, the board must 2-17 give students and administrators an opportunity to offer 2-18 recommendations to the board as to the type and scope of medical 2-19 services that should be provided. 2-20 (c) A medical services fee charged at a component 2-21 institution of the Texas State University System may be used only 2-22 to provide medical services to students registered at that 2-23 component institution. 2-24 (d) A medical services fee charged under this section is in 2-25 addition to any other fee the board is authorized by law to charge 2-26 and may not be considered in determining the maximum student 2-27 services fee that may be charged students enrolled at a component 3-1 institution of the Texas State University System under Section 3-2 54.503(b) of this code. 3-3 SECTION 3. Subchapter E, Chapter 54, Education Code, is 3-4 amended by adding Section 54.50891 to read as follows: 3-5 Sec. 54.50891. MEDICAL SERVICES FEE; THE UNIVERSITY OF TEXAS 3-6 SYSTEM COMPONENTS. (a) The board of regents of The University of 3-7 Texas System may charge each student registered at a component 3-8 institution of The University of Texas System a medical services 3-9 fee not to exceed $55 for each semester of the regular term or 3-10 12-week summer session and not to exceed $25 for each six-week or 3-11 shorter term of the summer session. 3-12 (b) Before charging a medical services fee, the board must 3-13 give students and administrators an opportunity to offer 3-14 recommendations to the board as to the type and scope of medical 3-15 services that should be provided. 3-16 (c) A medical services fee charged at a component 3-17 institution of The University of Texas System may be used only to 3-18 provide medical services to students registered at that component 3-19 institution. 3-20 (d) A medical services fee charged under this section is in 3-21 addition to any other fee the board is authorized by law to charge 3-22 and may not be considered in determining the maximum student 3-23 services fee that may be charged students enrolled at a component 3-24 institution of The University of Texas System. 3-25 SECTION 4. (a) The changes in law made by this Act to 3-26 Section 54.507, Education Code, apply beginning with the fall 3-27 semester in 1993. 4-1 (b) Sections 54.5089 and 54.50891, Education Code, as added 4-2 by this Act, apply beginning with the fall semester 1993. 4-3 SECTION 5. The importance of this legislation and the 4-4 crowded condition of the calendars in both houses create an 4-5 emergency and an imperative public necessity that the 4-6 constitutional rule requiring bills to be read on three several 4-7 days in each house be suspended, and this rule is hereby suspended, 4-8 and that this Act take effect and be in force from and after its 4-9 passage, and it is so enacted.
