1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to use of an electronic funds transfer system by a county.
1-22 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-23 SECTION 1. Subsection (b), Section 113.041, Local Government
1-24 Code, is amended to read as follows:
1-25 (b) Except as provided by Chapter 156, a <A> person may not
1-26 spend or withdraw money from the county treasury except by a check
1-27 or warrant drawn on the county treasury, whether or not the money
1-28 is in a county depository as required by law.
1-29 SECTION 2. Section 156.001, Local Government Code, is
1-30 amended to read as follows:
1-31 Sec. 156.001. TRANSFER SYSTEM AUTHORIZED. A county may
1-32 establish and operate an electronic funds transfer system to make
1-33 any authorized transfer from the county treasury <the following
1-34 items directly into officers' and employees' accounts in financial
1-35 institutions only:>
1-36 <(1) the net pay of the officers and employees;>
1-37 <(2) payments for the travel and subsistence of the
1-38 officers and employees; and>
1-39 <(3) all other forms of compensation, payment, or
1-40 reimbursement paid to the officers and employees>.
1-41 SECTION 3. Section 156.002, Local Government Code, is
1-42 repealed.
1-43 SECTION 4. The importance of this legislation and the
1-44 crowded condition of the calendars in both houses create an
1-45 emergency and an imperative public necessity that the
1-46 constitutional rule requiring bills to be read on three several
1-47 days in each house be suspended, and this rule is hereby suspended,
1-48 and that this Act take effect and be in force from and after its
1-49 passage, and it is so enacted.
