4-1 COMMITTEE AMENDMENT NO. 1
4-2 Amend S.B. 706, in Section 2 of the bill, by striking added
4-3 Subsection (d), Section 443.013, Government Code, and substituting
4-4 the following:
4-5 (d) The board may establish, manage, and operate gift and
4-6 souvenir shops in the Capitol and in the General Land Office
4-7 Building. The board may deposit money it receives under this
4-8 subsection to the credit of a separate account in the Capitol fund
4-9 and may spend money in the account only for:
4-10 (1) the benefit of the buildings;
4-11 (2) educational programs related to the General Land
4-12 Office Building and the historical portion of the Capitol; and
4-13 (3) operation of the gift and souvenir shops and a
4-14 Capitol Complex visitors center in the General land Office
4-15 Building.

4-18 Amend S.B. 706 by inserting in the bill an appropriately
4-19 numbered section to read as follows and renumbering the remaining
4-20 sections of the bill appropriately:
4-21 SECTION ____. Chapter 443, Government Code, is amended by
4-22 adding Section 443.0135 to read as follows:
4-23 Sec. 443.0135. ALCOHOLIC BEVERAGES. (a) The following
4-24 activities are prohibited in the Capitol, including the Capitol
4-25 extension and on its grounds:
4-26 (1) the sale of alcoholic beverages;
4-27 (2) the gift of alcoholic beverages in open containers
5-1 or for on-premises consumption;
5-2 (3) the consumption of alcoholic beverages; and
5-3 (4) the possession of an open container of an
5-4 alcoholic beverage.
5-5 (b) Subsections (a)(2), (3), and (4) are not applicable in
5-6 the offices, reception areas, and other similar areas under the
5-7 control of the legislature, a legislative agency, the governor, or
5-8 another officer of the state.
5-9 (c) Subsections (a)(2), (3), and (4) are not applicable to
5-10 celebrations of events of significant importance to the history of
5-11 the Capitol if consumption of alcoholic beverages at the event is
5-12 approved by the board.
5-13 (d) The board may adopt rules that permit the sale, gift,
5-14 consumption, and possession of an open container of alcoholic
5-15 beverages at celebrations of events of significant importance to
5-16 the history of the Capitol and may determine the historical events
5-17 that qualify as events of significant importance to the history of
5-18 the Capitol.
5-19 (e) The board shall submit a written report to the regular
5-20 session of the legislature convening in the third year following
5-21 the year in which the federal decennial census is taken regarding
5-22 the relationship of the prohibitions established by this section
5-23 and the preservation of buildings and other property on the Capitol
5-24 grounds.

5-27 Amend S.B. 706 by striking Section 2 of the bill and
6-1 substituting the following:
6-2 SECTION 2. Section 443.013, Government Code, is amended by
6-3 amending Subsections (b) and (c) and adding Subsections (d) and (e)
6-4 to read as follows:
6-5 (b) The board may charge a vendor a reasonable fee or a
6-6 percentage of gross or net sales for the right to operate in the
6-7 Capitol and may charge a royalty on items sold. Revenue received
6-8 under this section <from fees and royalties> shall be deposited in
6-9 the Capitol fund. Revenue received from a food service vendor
6-10 under this section shall be deposited to the credit of a separate
6-11 account in the fund, and money in the account may be used only for
6-12 the purchase and maintenance of equipment, furnishings, and space
6-13 related to food service in the Capitol.
6-14 (c) Chapter 94, Human Resources Code, does not apply to a
6-15 vending facility approved or operated by the board under this
6-16 section.
6-17 (d) The board may establish, manage, and operate gift and
