   1-16  COMMITTEE SUBSTITUTE FOR S.B. No. 706                    By:  Haley
   1-17                         A BILL TO BE ENTITLED
   1-18                                AN ACT
   1-19  relating to the powers and duties of the State Preservation Board.
   1-20        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-21        SECTION 1.  Section 443.007, Government Code, is amended by
   1-22  adding Subsection (d) to read as follows:
   1-23        (d)  The board may purchase insurance policies to insure the
   1-24  buildings and the contents of the buildings against any insurable
   1-25  risk that arises out of a construction or preservation project.
   1-26        SECTION 2.  Section 443.013, Government Code, is amended by
   1-27  amending Subsections (b) and (c) and adding Subsection (d) to read
   1-28  as follows:
   1-29        (b)  The board may charge a vendor a reasonable fee or a
   1-30  percentage of gross or net sales for the right to operate in the
   1-31  Capitol and may charge a royalty on items sold.  Revenue received
   1-32  under this section <from fees and royalties> shall be deposited in
   1-33  the Capitol fund.  Revenue received from a food service vendor
   1-34  under this section shall be deposited to the credit of a separate
   1-35  account in the fund, and money in the account may be used only for
   1-36  the purchase and maintenance of equipment, furnishings, and space
   1-37  related to food service in the Capitol.
   1-38        (c)  Chapter 94, Human Resources Code, does not apply to a
   1-39  vending facility approved or operated by the board under this
   1-40  section.
   1-41        (d)  The board may establish, manage, and operate gift and
   1-42  souvenir shops in the Capitol and in the General Land Office
   1-43  Building.  The board may deposit money it receives under this
   1-44  subsection to the credit of a separate account in the Capitol fund
   1-45  and may spend money in the account only for the benefit of the
   1-46  buildings and for educational programs related to the General Land
   1-47  Office Building and the historical portion of the Capitol.
   1-48        SECTION 3.  Chapter 443, Government Code, is amended by
   1-49  adding Sections 443.0131 and 443.0132 to read as follows:
   1-50        Sec. 443.0131.  RENTAL OF SPACE TO NEWS MEDIA.  The board may
   1-51  set and collect a fee from news media representatives for the
   1-52  rental of space in the Capitol.  The fee shall be set in an amount
   1-53  designed to recover the board's costs in furnishing and maintaining
   1-54  the space.  The board shall deposit money received under this
   1-55  section to the credit of a separate account in the Capitol fund.
   1-56  Money in the account may be used only to maintain and furnish the
   1-57  space rented to news media representatives.
   1-58        Sec. 443.0132.  FEE FOR USE OF GENERAL LAND OFFICE BUILDING.
   1-59  The board may set and collect a fee for public use of the building
   1-60  for special activities.  The fee shall be set in an  amount
   1-61  designed to pay for the maintenance and operation of a Capitol
   1-62  Complex visitors center in the building.  The board shall deposit
   1-63  money received under this section to the credit of a separate
   1-64  account in the Capitol fund.  Money in the account may be used only
   1-65  for the maintenance and operation of a Capitol Complex visitors
   1-66  center in the building.
   1-67        SECTION 4.  The importance of this legislation and the
   1-68  crowded condition of the calendars in both houses create an
    2-1  emergency and an imperative public necessity that the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended,
    2-4  and that this Act take effect and be in force from and after its
    2-5  passage, and it is so enacted.
