By: Rosson S.B. No. 771 A BILL TO BE ENTITLED AN ACT 1-1 relating to medical records 100 years old or older. 1-2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-3 SECTION 1. Subsection (d), Section 5.08, Medical Practice 1-4 Act (Article 4495b, Vernon's Texas Civil Statutes), is amended to 1-5 read as follows: 1-6 (d) The prohibitions of this section continue to apply to 1-7 confidential communications or records concerning any patient 1-8 irrespective of when the patient received the services of a 1-9 physician, except for medical records 100 years old or older 1-10 requested for historical research purposes. 1-11 SECTION 2. This Act takes effect September 1, 1993. 1-12 SECTION 3. The importance of this legislation and the 1-13 crowded condition of the calendars in both houses create an 1-14 emergency and an imperative public necessity that the 1-15 constitutional rule requiring bills to be read on three several 1-16 days in each house be suspended, and this rule is hereby suspended, 1-17 and that this Act take effect and be in force from and after its 1-18 passage, and it is so enacted.
