                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to medical records 100 years or older
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Section 5.08 (d) of the Medical Practice Act
    1-4  (Article 4495 b, Vernon's Texas Civil Statutes) is amended to read
    1-5  as follows:
    1-6        (d)  The prohibitions of this section continue to apply to
    1-7  confidential communications or records concerning any patient
    1-8  irrespective of when the patient received the services of a
    1-9  physician, except for medical records 100 years old or older,
   1-10  requested for historical research purposes.
   1-11        SECTION 2.  This act is effective on September 1, 1993.
   1-12        SECTION 3.  The importance of this legislation and the
   1-13  crowded condition of the calendars in both houses create an
   1-14  emergency and an imperative public necessity that the
   1-15  constitutional rule requiring bills to be read on three several
   1-16  days in each house be suspended, and this rule is hereby suspended,
   1-17  and that this Act take effect and be in force from and after its
   1-18  passage, and it is so enacted.
