No. 781 A BILL TO BE ENTITLED AN ACT 1-1 relating to prohibiting employment discrimination against deputy 1-2 sheriffs in certain counties for refusing to take a polygraph 1-3 examination. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter Z, Chapter 157, Local Government Code, 1-6 is amended by adding Section 157.905 to read as follows: 1-7 Sec. 157.905. POLYGRAPH EXAMINATION OF DEPUTY SHERIFF IN 1-8 CERTAIN SHERIFF'S DEPARTMENTS. (a) This section applies only to a 1-9 person appointed as a deputy sheriff in a sheriff's department in a 1-10 county with a population of 2.8 million or more. 1-11 (b) A deputy sheriff may not be suspended, discharged, or 1-12 subjected to any other form of employment discrimination because 1-13 the deputy refuses to take a polygraph examination. 1-14 SECTION 2. The importance of this legislation and the 1-15 crowded condition of the calendars in both houses create an 1-16 emergency and an imperative public necessity that the 1-17 constitutional rule requiring bills to be read on three several 1-18 days in each house be suspended, and this rule is hereby suspended, 1-19 and that this Act take effect and be in force from and after its 1-20 passage, and it is so enacted.
