                                        AN ACT
    1-1  relating to prohibiting employment discrimination against deputy
    1-2  sheriffs in certain counties for refusing to take a polygraph
    1-3  examination.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter Z, Chapter 157, Local Government Code,
    1-6  is amended by adding Section 157.905 to read as follows:
    1-7        Sec. 157.905.  POLYGRAPH EXAMINATION OF DEPUTY SHERIFF IN
    1-8  CERTAIN SHERIFF'S DEPARTMENTS.  (a)  This section applies only to a
    1-9  person appointed as a deputy sheriff in a sheriff's department in a
   1-10  county with a population of 2.8 million or more.
   1-11        (b)  Except as provided herein, a deputy sheriff may not be
   1-12  suspended, discharged, or subjected to any other form of employment
   1-13  discrimination because the deputy sheriff refuses to take a
   1-14  polygraph examination.  Discipline may be given to a deputy sheriff
   1-15  who refuses to take a polygraph examination if such deputy sheriff
   1-16  is the subject of a complaint and the complainant against such
   1-17  deputy sheriff has, in the course of the department's investigation
   1-18  of the complaint, previously taken and successfully passed a
   1-19  polygraph examination.
   1-20        SECTION 2.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended,
    2-1  and that this Act take effect and be in force from and after its
    2-2  passage, and it is so enacted.
