1-21 A BILL TO BE ENTITLED
1-22 AN ACT
1-23 relating to prohibiting employment discrimination against deputy
1-24 sheriffs in certain counties for refusing to take a polygraph
1-25 examination.
1-26 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-27 SECTION 1. Subchapter Z, Chapter 157, Local Government Code,
1-28 is amended by adding Section 157.905 to read as follows:
1-29 Sec. 157.905. POLYGRAPH EXAMINATION OF DEPUTY SHERIFF IN
1-30 CERTAIN SHERIFF'S DEPARTMENTS. (a) This section applies only to a
1-31 person appointed as a deputy sheriff in a sheriff's department in a
1-32 county with a population of 2.8 million or more.
1-33 (b) A deputy sheriff may not be suspended, discharged, or
1-34 subjected to any other form of employment discrimination because
1-35 the deputy refuses to take a polygraph examination.
1-36 SECTION 2. The importance of this legislation and the
1-37 crowded condition of the calendars in both houses create an
1-38 emergency and an imperative public necessity that the
1-39 constitutional rule requiring bills to be read on three several
1-40 days in each house be suspended, and this rule is hereby suspended,
1-41 and that this Act take effect and be in force from and after its
1-42 passage, and it is so enacted.
