A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to a clarification of a commercial landlord's remedies for
1-3 nonpayment of rent.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 93.002(f), Property Code, is amended to
1-6 read as follows:
1-7 (f) If a landlord or a landlord's agent changes the door
1-8 lock of a tenant who is delinquent in paying rent, the landlord or
1-9 agent must place a written notice on the tenant's front door
1-10 stating the name and the address or telephone number of the
1-11 individual or company from which the new key may be obtained. The
1-12 new key is required to be provided only during the tenant's regular
1-13 business hours and only if the tenant pays the delinquent rent.
1-14 SECTION 2. This Act takes effect September 1, 1993.
1-15 SECTION 3. The importance of this legislation and the
1-16 crowded condition of the calendars in both houses create an
1-17 emergency and an imperative public necessity that the
1-18 constitutional rule requiring bills to be read on three several
1-19 days in each house be suspended, and this rule is hereby suspended.
