                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the regulation of smoking in cells housing inmates of
    1-3  the institutional division of the Texas Department of Criminal
    1-4  Justice, certain public areas in the institutional division, and
    1-5  vehicles transporting inmates of the institutional division.
    1-6        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-7        SECTION 1.  Subchapter A, Chapter 501, Government Code, is
    1-8  amended by adding Section 501.018 to read as follows:
    1-9        Sec. 501.018.  SMOKING.  (a)  The institutional division
   1-10  shall designate a sufficient number of cells as nonsmoking cells.
   1-11  On request of an inmate, the division shall house the inmate in a
   1-12  nonsmoking cell.  The division shall prohibit smoking in a
   1-13  nonsmoking cell.
   1-14        (b)  The institutional division shall designate a nonsmoking
   1-15  area in each public indoor area in the division in which inmates or
   1-16  visitors may gather.  The division shall prohibit smoking in
   1-17  nonsmoking areas.
   1-18        (c)  The institutional division shall prohibit smoking in a
   1-19  vehicle of the division in which inmates are being transported.
   1-20        SECTION 2.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended,
    2-1  and that this Act take effect and be in force from and after its
    2-2  passage, and it is so enacted.
