73R11295 MWV-D By Montford S.B. No. 867 Substitute the following for S.B. No. 867: By Chisum C.S.S.B. No. 867 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the location of certain justice of the peace courts. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subsection (d), Section 292.001, Local Government 1-5 Code, is amended to read as follows: 1-6 (d) A justice of the peace court may not be housed or 1-7 conducted in a building located outside the court's precinct except 1-8 as provided by Section 27.051(f), Government Code, or unless the 1-9 justice of the peace court is situated in the county courthouse in 1-10 a county with a population of at least 220,000 persons but no more 1-11 than 230,000 persons. 1-12 SECTION 2. Section 27.051(f), Government Code, is amended to 1-13 read as follows: 1-14 (f) A justice of the peace of a precinct in a county with a 1-15 population of less than 30,000 may hold court in the county 1-16 courthouse, or another facility provided under Section 292.002(a), 1-17 Local Government Code, for that purpose. If requested by the 1-18 justice, the commissioners court of the county may provide and 1-19 furnish a suitable place in the courthouse or another facility 1-20 provided under Section 292.002(a), Local Government Code, for the 1-21 justice to hold court. 1-22 SECTION 3. This Act takes effect September 1, 1993. 1-23 SECTION 4. The importance of this legislation and the 1-24 crowded condition of the calendars in both houses create an 2-1 emergency and an imperative public necessity that the 2-2 constitutional rule requiring bills to be read on three several 2-3 days in each house be suspended, and this rule is hereby suspended.
