                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the appointment of the directors of the Valley Acres
    1-3  Water District.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 3, Chapter 261, Acts of the 52nd
    1-6  Legislature, Regular Session, 1951 (Article 8280-143, Vernon's
    1-7  Texas Civil Statutes), is amended to read as follows:
    1-8        Sec. 3.  The management and control of the District is hereby
    1-9  vested in a board of directors which shall have all of the powers
   1-10  and authority conferred and imposed upon Board of Directors of
   1-11  Water Control and Improvement Districts organized under the
   1-12  provisions of Chapter 51, Water Code <25, Acts of the Thirty-ninth
   1-13  Legislature passed in 1925 and amendments thereto, as incorporated
   1-14  in Title 128, Chapter 3A of Vernon's Civil Statutes of the State of
   1-15  Texas and amendments thereto>.  The Board of Directors shall be
   1-16  composed of five (5) members who shall qualify to serve as
   1-17  directors in the same manner as elected directors qualify under
   1-18  Chapter 51, Water Code <have the same qualifications as Directors
   1-19  of Water Control and Improvement Districts>.  In the event, and to
   1-20  the extent that any of the provisions of the general laws referred
   1-21  to in this Section are in conflict with or inconsistent with any of
   1-22  the provisions of this Act relating to the powers, authority and
   1-23  duties of the Board of Directors and its members, the provisions of
   1-24  this Act shall prevail.  The commissioners of the Texas Water
    2-1  Commission shall appoint the members of the Board of Directors to
    2-2  staggered four-year terms.  The commissioners of the Texas Water
    2-3  Commission shall appoint an individual to fill any vacancy on the
    2-4  Board of Directors.  <The Board of Water Engineers of the State of
    2-5  Texas is hereby authorized and empowered to appoint five (5)
    2-6  persons qualified under the law to serve as directors of the
    2-7  District until their successors shall have been duly elected and
    2-8  shall have qualified.  The first election of directors shall be
    2-9  held on the second Tuesday in January, 1952, in accordance with the
   2-10  provisions of Section 37 of Chapter 25, Acts of the Thirty-ninth
   2-11  Legislature, as amended by Section 6 of Chapter 107 of the Acts of
   2-12  the First Called Session of the Fortieth Legislature, as carried
   2-13  forward in Article 7880-37 of Vernon's Civil Statutes of the State
   2-14  of Texas, and laws amendatory thereof and supplemental thereto.>
   2-15        SECTION 2.  (a)  The current elected members of the board of
   2-16  directors of the Valley Acres Water District continue to serve as
   2-17  board members until the date the members' terms expire.
   2-18        (b)  On the expiration of each current board member's term,
   2-19  the commissioners of the Texas Water Commission, in accordance with
   2-20  Section 3, Chapter 261, Acts of the 52nd Legislature, Regular
   2-21  Session, 1951 (Article 8280-143, Vernon's Texas Civil Statutes), as
   2-22  amended by this Act, shall appoint a member to the board of
   2-23  directors of the Valley Acres Water District to replace the member
   2-24  whose term expired.
   2-25        SECTION 3.  The importance of this legislation and the
   2-26  crowded condition of the calendars in both houses create an
   2-27  emergency and an imperative public necessity that the
    3-1  constitutional rule requiring bills to be read on three several
    3-2  days in each house be suspended, and this rule is hereby suspended,
    3-3  and that this Act take effect and be in force from and after its
    3-4  passage, and it is so enacted.
