1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to the appointment of the directors of the Valley Acres
1-22 Water District.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Section 3, Chapter 261, Acts of the 52nd
1-25 Legislature, 1951 (Article 8280-143, Vernon's Texas Civil
1-26 Statutes), is amended to read as follows:
1-27 Sec. 3. The management and control of the District is hereby
1-28 vested in a board of directors which shall have all of the powers
1-29 and authority conferred and imposed upon Board of Directors of
1-30 Water Control and Improvement Districts organized under the
1-31 provisions of Chapter 51, Water Code <25, Acts of the Thirty-ninth
1-32 Legislature passed in 1925 and amendments thereto, as incorporated
1-33 in Title 128, Chapter 3A of Vernon's Civil Statutes of the State of
1-34 Texas and amendments thereto>. The Board of Directors shall be
1-35 composed of five (5) members who shall qualify to serve as
1-36 directors in the same manner as elected directors qualify under
1-37 Chapter 51, Water Code <have the same qualifications as Directors
1-38 of Water Control and Improvement Districts>. In the event, and to
1-39 the extent that any of the provisions of the general laws referred
1-40 to in this Section are in conflict with or inconsistent with any of
1-41 the provisions of this Act relating to the powers, authority and
1-42 duties of the Board of Directors and its members, the provisions of
1-43 this Act shall prevail. The commissioners of the Texas Water
1-44 Commission shall appoint the members of the Board of Directors to
1-45 staggered four-year terms. The commissioners of the Texas Water
1-46 Commission shall appoint an individual to fill any vacancy on the
1-47 Board of Directors. <The Board of Water Engineers of the State of
1-48 Texas is hereby authorized and empowered to appoint five (5)
1-49 persons qualified under the law to serve as directors of the
1-50 District until their successors shall have been duly elected and
1-51 shall have qualified. The first election of directors shall be
1-52 held on the second Tuesday in January, 1952, in accordance with the
1-53 provisions of Section 37 of Chapter 25, Acts of the Thirty-ninth
1-54 Legislature, as amended by Section 6 of Chapter 107 of the Acts of
1-55 the First Called Session of the Fortieth Legislature, as carried
1-56 forward in Article 7880--37 of Vernon's Civil Statutes of the State
1-57 of Texas, and laws amendatory thereof and supplemental thereto.>
1-58 SECTION 2. (a) The current elected members of the board of
1-59 directors of the Valley Acres Water District continue to serve as
1-60 board members until the date the members' terms expire.
1-61 (b) On the expiration of each current board member's term,
1-62 the commissioners of the Texas Water Commission, in accordance with
1-63 Section 3, Chapter 261, Acts of the 52nd Legislature, 1951 (Article
1-64 8280-143, Vernon's Texas Civil Statutes), as amended by this Act,
1-65 shall appoint a member to the board of directors of the Valley
1-66 Acres Water District to replace the member whose term expired.
1-67 SECTION 3. The importance of this legislation and the
1-68 crowded condition of the calendars in both houses create an
2-1 emergency and an imperative public necessity that the
2-2 constitutional rule requiring bills to be read on three several
2-3 days in each house be suspended, and this rule is hereby suspended,
2-4 and that this Act take effect and be in force from and after its
2-5 passage, and it is so enacted.
