By: Armbrister S.B. No. 926 A BILL TO BE ENTITLED AN ACT 1-1 relating to the inspection of certain motor vehicles. 1-2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-3 SECTION 1. Section 141, Uniform Act Regulating Traffic on 1-4 Highways (Article 6701d, Vernon's Texas Civil Statutes), is amended 1-5 by adding Subsection (c-1) to read as follows: 1-6 (c-1) Notwithstanding Subsection (c) of Section 140 of this 1-7 Act and Subsection (c) of this section, a passenger car or light 1-8 truck that is sold in this state, has not been previously 1-9 registered in this or another state, and on the date of sale is of 1-10 the current or the immediately preceding model year is subject to 1-11 an initial inspection that expires at the end of two years. The 1-12 fee for compulsory inspection under this subsection is Nineteen 1-13 Dollars and Seventy-Five Cents ($19.75). The Department shall 1-14 require each official inspection station to make an advance payment 1-15 of Fourteen Dollars and Seventy-Five Cents ($14.75) for a 1-16 certificate to be issued under this subsection. The Department 1-17 shall remit to the comptroller Three Dollars and Seventy-Five Cents 1-18 ($3.75) of each fee for deposit to the credit of the undedicated 1-19 portion of the General Revenue Fund, Four Dollars ($4.00) of each 1-20 fee for deposit to the credit of an account in the General Revenue 1-21 Fund to be used only for the air quality program of the Texas 1-22 Natural Resource Conservation Commission, and the remainder of each 1-23 fee for deposit to the credit of the Motor Vehicle Inspection Fund. 1-24 No further payment may be required of a station for a certificate 2-1 under this subsection. Refunds for unissued certificates shall be 2-2 made in the same manner as provided for other certificate refunds. 2-3 This subsection does not preclude motor vehicle emission 2-4 inspections from being conducted during an initial certification 2-5 period under this subsection in counties covered by a federal 2-6 Environmental Protection Agency-approved inspection and maintenance 2-7 program pursuant to Subsection (d) of Section 142 of this Act and 2-8 the federal Clean Air Act (42 U.S.C. Section 7401 et seq.). An 2-9 inspection station may waive the fee otherwise due from the owner 2-10 of a vehicle inspected under this subsection. 2-11 SECTION 2. This Act takes effect September 1, 1993. 2-12 SECTION 3. The importance of this legislation and the 2-13 crowded condition of the calendars in both houses create an 2-14 emergency and an imperative public necessity that the 2-15 constitutional rule requiring bills to be read on three several 2-16 days in each house be suspended, and this rule is hereby suspended.
