By: Brown S.B. No. 938 A BILL TO BE ENTITLED AN ACT 1-1 relating to separate property of a spouse. 1-2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-3 SECTION 1. Section 3.63, Family Code, is amended by adding a 1-4 new Subsection (c), to read as follows: 1-5 (c) In a decree of divorce or annulment the court shall 1-6 treat the following real and personal property, wherever situated, 1-7 as the separate property of a spouse: 1-8 (1) property that was acquired by a spouse while 1-9 domiciled elsewhere that would have been separate property if the 1-10 spouse who acquired the property had been domiciled in this state 1-11 at the time of the acquisition; or 1-12 (2) property that was acquired by a spouse in exchange 1-13 for real or personal property and that would have been separate 1-14 property if the spouse who acquired the property so exchanged had 1-15 been domiciled in this state at the time of its acquisition. 1-16 SECTION 2. This Act takes effect September 1, 1993. 1-17 SECTION 3. The importance of this legislation and the 1-18 crowded condition of the calendars in both houses create an 1-19 emergency and an imperative public necessity that the 1-20 constitutional rule requiring bills to be read on three several 1-21 days in each house be suspended, and this rule is hereby suspended.
