A BILL TO BE ENTITLED
AN ACT
1-1 relating to the composition, termination, and duties of the
1-2 Legislative Natural Resources Board.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 10.02, Chapter 3, Acts of the 72nd
1-5 Legislature, 1st Called Session, 1991, is amended to read as
1-6 follows:
1-7 Sec. 10.02. The board is composed of:
1-8 (1) the chair of the House Environmental Regulation
1-9 <Affairs> Committee;
1-10 (2) the chair of the Senate Natural Resources
1-11 Committee;
1-12 (3) the chair of the House Natural Resources
1-13 Committee;
1-14 (4) the chair of the Senate Finance Committee;
1-15 (5) the chair of the House Appropriations <Government
1-16 Organization> Committee; and
1-17 (6) the chair of the Senate State Affairs Committee.
1-18 SECTION 2. Section 10.03, Chapter 3, Acts of the 72nd
1-19 Legislature, 1st Called Session, 1991, is amended to read as
1-20 follows:
1-21 Sec. 10.03. The board shall oversee and review the
1-22 implementation of legislative natural resources policy by state
1-23 agencies that have the statutory duty to implement that policy.
2-1 The board shall oversee and review the implementation of federal
2-2 environmental programs delegated to the state. The board may
2-3 require information and reports from state agencies as necessary to
2-4 carry out its oversight and review duties.
2-5 SECTION 3. Section 10.04, Chapter 3, Acts of the 72nd
2-6 Legislature, 1st Called Session, 1991, is amended to read as
2-7 follows:
2-8 Sec. 10.04. The board <shall continue its review and
2-9 oversight activities during the transition period to the full Texas
2-10 Natural Resources Conservation Commission. The board shall
2-11 terminate its duties effective January 1, 1994.> may receive
2-12 grants, appropriations, or property from any source. The board may
2-13 contract with state or federal agencies to support the
2-14 implementation of legislative natural resource policy.
2-15 SECTION 4. Section 10.05, Chapter 3, Acts of the 72nd
2-16 Legislature, 1st Called Session, 1991, is amended to read as
2-17 follows:
2-18 Sec. 10.05. At a minimum, the board shall ensure that agency
2-19 <transition> activities <do not>:
2-20 (1) do not delay or prejudice any permit processing
2-21 activities;
2-22 (2) do not result in undue duplication of effort;
2-23 (3) do not impede progress toward activities ensuring
2-24 the delegation of federal environmental programs; <and>
2-25 (4) ensure compliance with the provisions of this Act;
3-1 and
3-2 (5) do not result in duplicative or conflicting rules.
3-3 SECTION 5. The importance of this legislation and the
3-4 crowded condition of the calendars in both houses create an
3-5 emergency and an imperative public necessity that the
3-6 constitutional rule requiring bills to be read on three several
3-7 days in each house be suspended, and this rule is hereby suspended,
3-8 and that this Act take effect and be in force according to its
3-9 terms, and it is so enacted.
