1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to the service area for a municipal drainage utility
1-22 system.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Subdivision (8), Section 402.044, Local
1-25 Government Code, is amended to read as follows:
1-26 (8) "Service area" means the municipal boundaries and
1-27 any other land areas outside the municipal boundaries which, as a
1-28 result of topography or hydraulics, contribute overland flow into
1-29 the watersheds served by the drainage system of a municipality;
1-30 provided, however, that in no event may a service area extend
1-31 farther than the boundaries of a municipality's current
1-32 extraterritorial jurisdiction, nor may a service area of one
1-33 municipality extend into the boundaries of another incorporated
1-34 town, city, or municipality. The service area is to be
1-35 established in the ordinance establishing the drainage utility.
1-36 Provided, that no municipality shall extend a service area outside
1-37 of its municipal boundaries except:
1-38 (A) a municipality of more than 400,000
1-39 population located in one or more counties of less than 600,000
1-40 population according to the most recent federal census; or
1-41 (B) a municipality all or part of which is
1-42 located over or within the Edwards Aquifer recharge zone or the
1-43 Edwards Aquifer transition zone, as designated by the Texas Water
1-44 Commission.
1-45 SECTION 2. The importance of this legislation and the
1-46 crowded condition of the calendars in both houses create an
1-47 emergency and an imperative public necessity that the
1-48 constitutional rule requiring bills to be read on three several
1-49 days in each house be suspended, and this rule is hereby suspended,
1-50 and that this Act take effect and be in force from and after its
1-51 passage, and it is so enacted.
