                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to extension beyond a municipality's boundaries of certain
    1-2  municipal regulations to protect water quality.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter A, Chapter 212, Local Government Code,
    1-5  is amended by adding Section 212.0031 to read as follows:
    1-6        Sec. 212.0031.  EXTENSION OF RULES TO PROTECT WATER QUALITY
    1-7  OF AQUIFER RECHARGE ZONE.  (a)  This section applies only to a
    1-8  municipality:
    1-9              (1)  with a population of less than 30,000; and
   1-10              (2)  all or part of which is located over the northern
   1-11  Edwards Aquifer recharge zone, as designated by the Texas Water
   1-12  Commission and which is an area of interest to the entire state.
   1-13        (b)  Notwithstanding any other provision of this subchapter,
   1-14  the governing body of a municipality to which this section applies
   1-15  may extend the application of any municipal ordinance adopted under
   1-16  Section 212.002 to an area within the municipality's
   1-17  extraterritorial jurisdiction as necessary to protect the water
   1-18  quality of the aquifer.
   1-19        SECTION 2.  The importance of this legislation and the
   1-20  crowded condition of the calendars in both houses create an
   1-21  emergency and an imperative public necessity that the
   1-22  constitutional rule requiring bills to be read on three several
   1-23  days in each house be suspended, and this rule is hereby suspended,
   1-24  and that this Act take effect and be in force from and after its
    2-1  passage, and it is so enacted.
