  7-1                          COMMITTEE AMENDMENT NO. 1
  7-2     Amend S.B. 994 as follows:
  7-3           (1)  In Section 1 of the bill, in Section 11.2011, Education
  7-4     Code (page 1, lines 5-16), strike subsection (a) and substitute the
  7-5     following:
  7-6           "(a)  The Central Education Agency shall establish a pilot
  7-7     program for the development of community education child care
  7-8     services as outlined in this section.  The program established
  7-9     under this section is required only in school districts in which
 7-10     the program is financed by funds distributed under this section and
 7-11     any other funds available to the program.  The agency shall
 7-12     actively seek gifts, grants or other donations for purposes related
 7-13     to before- and after-school child care, unless the acceptance is
 7-14     prohibited by some other law.  Money received under this subsection
 7-15     shall be deposited in the before- and after-school child care
 7-16     account established pursuant to subsection (b) and may be
 7-17     appropriated only for the purpose for which the money was given."
 7-18           (2)  In Section 1 of the bill, in Section 11.2011, Education
 7-19     Code (page 1, line 17), add a new subsection (b) and reletter the
 7-20     existing subsections accordingly:
 7-21           "(b)  The before- and after-school child care account is
 7-22     created as a dedicated account within the Foundation School Fund in
 7-23     the state treasury.  The account shall consist of child care
 7-24     related gifts, grants and donations, and shall be administered by
 7-25     the Central Education Agency."
 7-26           (3)  On page 1, line 23, delete the sentence beginning after
 7-27     the period.

  8-3     Amend S.B. 994 as follows:
  8-4           (1)  Add a new Section 3, to read as follows:
  8-5           SECTION 3.  It is the intent of the Legislature that the
  8-6     pilot program established in Section 11.2011, Education Code, as
  8-7     added by this Act, be financed only from funds appropriated by the
  8-8     Legislature specifically for that purpose, and from any gifts,
  8-9     grants or donations accepted for the purpose of the pilot program.
 8-10     The amount appropriated by the Legislature for the 1994-1995
 8-11     biennium, excluding gifts, grants and donations, may not exceed $4
 8-12     million.
 8-13           (2)  Renumber the remaining section accordingly.
