By: Armbrister S.B. No. 1027 A BILL TO BE ENTITLED AN ACT 1-1 relating to zoning regulations. 1-2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-3 SECTION 1. Section 211.003, Chapter 211, Title 7, Local 1-4 Government Code is amended to read as follows: 1-5 Sec. 211.003. Zoning Regulations Generally. (a) The 1-6 governing body of a municipality may regulate: 1-7 (1) the height, number of stories, and size of 1-8 buildings and other structures; 1-9 (2) the percentage of a lot that may be occupied; 1-10 (3) the size of yards, courts, and other open spaces; 1-11 (4) population density; and 1-12 (5) the location and use of buildings, other 1-13 structures, and land for business, industrial, residential, or 1-14 other purposes. 1-15 (b) In the case of designated places and areas of 1-16 historical, cultural, or architectural importance and significance, 1-17 the governing body of a municipality may regulate the construction, 1-18 reconstruction, alteration, or razing of buildings and other 1-19 structures. 1-20 (c) The governing body of a home-rule municipality may also 1-21 regulate the bulk of buildings. 1-22 (d) The governing body of a municipality may not regulate 1-23 new manufactured or industrialized housing, constructed to 2-1 preemptive state or federal building standards, for siting or 2-2 zoning purposes in any manner that is different from regulation of 2-3 site-built housing. 2-4 SECTION 2. The importance of this legislation and the 2-5 crowded condition of the calendars in both houses create an 2-6 emergency and an imperative public necessity that the 2-7 constitutional rule requiring bills to be read on three several 2-8 days in each house be suspended, and this rule is hereby suspended, 2-9 and that this Act take effect and be in force from and after its 2-10 passage, and it is so enacted.
