1-21 A BILL TO BE ENTITLED
1-22 AN ACT
1-23 relating to the review and approval of certain permits by the
1-24 state, a municipality, and other local governmental entities.
1-25 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-26 SECTION 1. Subdivision (3), Subsection (a), Section 481.142,
1-27 Government Code, is amended to read as follows:
1-28 (3) "Project" means an endeavor over which a
1-29 regulatory agency exerts its jurisdiction and for which a permit is
1-30 required before initiation of the endeavor. Preliminary plans and
1-31 related subdivision plats, site plans and site development permits
1-32 connected to such preliminary plan or subdivision plats are
1-33 considered collectively to be one project, provided that each site
1-34 plan is submitted to the regulatory agency within three years after
1-35 the final plat of the subdivision for such site plan is approved.
1-36 All property that is under common ownership or control and that is
1-37 subject to one or more applications for subdivision shall be
1-38 considered to be one project.
1-39 SECTION 2. Subdivision (4), Subsection (a), Section 481.142,
1-40 Government Code, is amended to read as follows:
1-41 (4) "Regulatory agency" means a political subdivision
1-42 and the governing bodies or any boards or commissions thereof, an
1-43 agency, bureau, department, division, or commission of the state or
1-44 any department or other agency of a political subdivision that
1-45 processes and issues permits.
1-46 SECTION 3. Section 481.143, Government Code, is amended to
1-47 read as follows:
1-48 Sec. 481.143. Uniformity of Requirements. (a) The
1-49 approval, disapproval, or conditional approval of an application
1-50 for a permit shall be considered by each regulatory agency solely
1-51 on the basis of any orders, regulations, ordinances, or other duly
1-52 adopted requirements in effect at the time the original application
1-53 for the permit is filed. If a series of permits is required for a
1-54 project and if the project is initiated within two years after the
1-55 last required permit is approved, the orders, regulations,
1-56 ordinances, or other requirements in effect at the time the
1-57 original application for the first permit in that series is filed
1-58 shall be the sole basis for consideration of all subsequent permits
1-59 required for the completion of the project and all permits required
1-60 for the project shall be considered to be a single series of
1-61 permits. The project will be considered to have been initiated if
1-62 plans are prepared and the ground is broken for the first phase of
1-63 the project. The project and subsequent phases must be in a
1-64 continuous process of completion and be completed as soon as
1-65 reasonably possible consistent with generally accepted local
1-66 standards and practices, provided that the project shall be
1-67 considered to be in a continuous process of completion during any
1-68 period in which completion or initiation is interrupted for any
2-1 reason or circumstance beyond the control of the persons to whom
2-2 the permit has been issued as a result of an action taken by a
2-3 regulatory agency or other governmental entity or agency thereof.
2-4 (b) This subchapter applies to all projects in progress on
2-5 or commenced after the effective date of this section as originally
2-6 enacted, and the duly adopted requirements in effect at the time
2-7 the original application for the first permit for the project was
2-8 filed control.
2-9 (c) This section does not apply to:
2-10 (1) permits or licenses issued in connection with any
2-11 form of gaming or gambling;
2-12 (2) permits or licenses issued under Title 2, Tax
2-13 Code; <or>
2-14 (3) permits or orders issued under programs for which
2-15 a state regulatory agency has received authorization, delegation,
2-16 or approval from the federal government to implement an equivalent
2-17 state program in lieu of or as part of the federal program; or
2-18 (4) permits for the construction of buildings or
2-19 structures intended for human occupancy or habitation that are
2-20 issued pursuant to laws, ordinances, procedures, rules, and
2-21 regulations adopting solely the provisions of uniform building,
2-22 fire, electrical, plumbing, or mechanical codes promulgated by the
2-23 International Conference of Building Officials, the International
2-24 Fire Code Institute, or the International Association of Plumbing
2-25 and Mechanical Officials unless such permits are less than two
2-26 years old.
2-27 SECTION 4. The importance of this legislation and the
2-28 crowded condition of the calendars in both houses create an
2-29 emergency and an imperative public necessity that the
2-30 constitutional rule requiring bills to be read on three several
2-31 days in each house be suspended, and this rule is hereby suspended,
2-32 and that this Act take effect and be in force from and after its
2-33 passage, and it is so enacted.
