                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the issuance of licenses, stamps, permits, and tags by
    1-3  the Parks and Wildlife Department.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Sections 11.056(a) and (c), Parks and Wildlife
    1-6  Code, are amended to read as follows:
    1-7        (a)  The price of a wildlife art decal or stamp sold under
    1-8  this subchapter is $5.00 or an amount set by the commission,
    1-9  whichever amount is more.
   1-10        (c)  A license deputy <An authorized agent> of the
   1-11  department<, other than a department employee,> who issues or
   1-12  collects money for <sells> the wildlife art decals or stamps may
   1-13  retain an amount set by the commission <50 cents> of each item sold
   1-14  as an issuance or <a> collection fee.
   1-15        SECTION 2.  Chapter 12, Parks and Wildlife Code, is amended
   1-16  by adding Subchapter H to read as follows:
   1-17                    SUBCHAPTER H.  LICENSE DEPUTIES
   1-18        Sec. 12.701.  ISSUANCE OF LICENSES, STAMPS, PERMITS, AND TAGS
   1-19  BY LICENSE DEPUTIES.  The department may authorize the issuance of
   1-20  licenses, stamps, permits, and tags by license deputies.
   1-21        Sec. 12.702.  LICENSE DEPUTIES:  FEES.  (a)  An employee of
   1-22  the department, a county clerk, or any other person or entity
   1-23  designated by the department to issue, and collect money received
   1-24  for, licenses, stamps, permits, and tags is a license deputy and
    2-1  may issue and collect money for licenses, stamps, permits, and tags
    2-2  issued under the authority of this code.
    2-3        (b)  The commission by rule may set the amount of an issuance
    2-4  or collection fee for any license, stamp, tag, permit, or other
    2-5  similar item for which an amount is not expressly set by this code.
    2-6  Notwithstanding any other provision of this code, a license deputy
    2-7  who is an employee of the department may not retain an issuance or
    2-8  collection fee.
    2-9        Sec. 12.703.  DUTIES OF LICENSE DEPUTIES.  A license deputy
   2-10  shall:
   2-11              (1)  complete and keep for the use of the department
   2-12  the designated copy or other record of the sale of a license,
   2-13  stamp, permit, or tag;
   2-14              (2)  keep a record of all licenses, stamps, permits, or
   2-15  tags issued, showing the identification of each purchaser, the
   2-16  serial number of the item sold, the date of its issuance, and any
   2-17  other information required by the department; and
   2-18              (3)  perform any other function required by the
   2-19  deputy's agreement with the department.
   2-20        Sec. 12.704.  LICENSE, STAMP, PERMIT, AND TAG SALES REPORTS.
   2-21  (a)  After the end of each calendar month or at any other time
   2-22  designated by the department, a license deputy shall send to the
   2-23  department a report on a form and in the manner prescribed by the
   2-24  department.
   2-25        (b)  A license deputy shall furnish any other information or
   2-26  material required by the deputy's agreement with the department.
   2-27        Sec. 12.705.  UNISSUED ITEMS.  A license deputy shall return
    3-1  to the department an unissued license, stamp, permit, tag, or other
    3-2  material or equipment furnished to the license deputy by the
    3-3  department when requested by the department.
    3-4        Sec. 12.706.  ISSUANCE OR ACCEPTANCE OF LICENSES, STAMPS,
    3-5  PERMITS, AND TAGS.  No person may issue or accept a license, stamp,
    3-6  permit, or tag required by this code except on a form provided by
    3-7  the department.
    3-8        SECTION 3.  Section 42.001(1), Parks and Wildlife Code, is
    3-9  amended to read as follows:
   3-10              (1)  "Resident" means:
   3-11                    (A)  an individual who has resided continuously
   3-12  in this state for more than six months immediately before applying
   3-13  for a hunting license;
   3-14                    (B)  a member of the armed forces on active duty;
   3-15                    (C)  a dependent of a member of the armed forces
   3-16  on active duty; or
   3-17                    (D)  a member of any other category of
   3-18  individuals that the commission by regulation designates as
   3-19  residents.
   3-20        SECTION 4.  Section 42.012(a), Parks and Wildlife Code, is
   3-21  amended to read as follows:
   3-22        (a)  The fee for a resident hunting license is $8 or an
   3-23  amount set by the commission, whichever amount is more.  An amount
   3-24  set by the commission <Fifty cents of the fee> may be retained from
   3-25  the fee by a license deputy <an authorized agent, other than a
   3-26  department employee,> issuing the license and collecting the fee as
   3-27  an issuance or <his> collection fee.
    4-1        SECTION 5.  Section 42.014, Parks and Wildlife Code, is
    4-2  amended to read as follows:
    4-3        Sec. 42.014.  Nonresident Special License Fee.  The fee for a
    4-4  nonresident special hunting license is $37.75 or an amount set by
    4-5  the commission, whichever amount is more.  An amount set by the
    4-6  commission <Seventy-five cents of the fee> may be retained from the
    4-7  fee by the license deputy <officer, other than a department
    4-8  employee,> issuing the license and collecting the fee as an
    4-9  issuance or <his> collection fee.
   4-10        SECTION 6.  Section 42.0141, Parks and Wildlife Code, is
   4-11  amended to read as follows:
   4-12        Sec. 42.0141.  General Nonresident Hunting License Fee.  The
   4-13  fee for a general nonresident hunting license is $100.75 or an
   4-14  amount set by the commission, whichever amount is more.  An amount
   4-15  set by the commission <Seventy-five cents of the fee> may be
   4-16  retained from the fee by the license deputy <officer, other than a
   4-17  department employee,> issuing the license and collecting the fee as
   4-18  an issuance or <his> collection fee.
   4-19        SECTION 7.  Section 42.0142(b), Parks and Wildlife Code, is
   4-20  amended to read as follows:
   4-21        (b)  The fee for a nonresident banded bird hunting license is
   4-22  an amount set by the commission <in an amount not to exceed $10>.
   4-23  An amount set by the commission <Seventy-five cents of the fee> may
   4-24  be retained from the fee by a license deputy <an authorized agent,
   4-25  other than a department employee,> issuing the license and
   4-26  collecting the fee as an issuance or <his> collection fee.  <A
   4-27  nonresident banded bird hunting license may be sold by the
    5-1  department or private bird hunting area licensee subject to the
    5-2  same rules that apply to any other license deputy.>
    5-3        SECTION 8.  Section 42.0143, Parks and Wildlife Code, is
    5-4  amended to read as follows:
    5-5        Sec. 42.0143.  Nonresident Five-Day Special Hunting License.
    5-6  A nonresident five-day special hunting license is valid for five
    5-7  consecutive days.  The fee for the license is set by the commission
    5-8  in an amount not to exceed 50 percent of the amount of the fee set
    5-9  for a nonresident special hunting license.  An amount set by the
   5-10  commission <Seventy-five cents of the fee> may be retained from the
   5-11  fee by a license deputy <an authorized agent, other than a
   5-12  department employee,> issuing the license and collecting the fee as
   5-13  an issuance or <his> collection fee.
   5-14        SECTION 9.  Section 42.0144, Parks and Wildlife Code, is
   5-15  amended to read as follows:
   5-16        Sec. 42.0144.  Nonresident Spring Turkey Hunting License Fee.
   5-17  The fee for a nonresident spring turkey hunting license is $75 or
   5-18  an amount set by the commission, whichever amount is more.  An
   5-19  amount set by the commission may be retained from the fee by a
   5-20  license deputy issuing the license and collecting the fee as an
   5-21  issuance or collection fee.
   5-22        SECTION 10.  Sections 42.017(b) and (d), Parks and Wildlife
   5-23  Code, are amended to read as follows:
   5-24        (b)  The application for a duplicate license or tags is in
   5-25  the form of an affidavit and must contain a statement of fact
   5-26  concerning the loss or destruction of the license or tags and a
   5-27  statement of the number of birds or animals, if any, killed under
    6-1  the authority of the lost or destroyed license or tags.  The
    6-2  commission by regulation may prescribe additional information or
    6-3  forms required for the issuance of a duplicate license or tag under
    6-4  this section.
    6-5        (d)  The fee for a duplicate license or tags is $5 or an
    6-6  amount set by the commission, whichever amount is more.  An amount
    6-7  set by the commission <Fifty cents of the fee> may be retained from
    6-8  the fee by the license deputy <officer, other than a department
    6-9  employee,> issuing the license and collecting the fee as an
   6-10  issuance or <his> collection fee.
   6-11        SECTION 11.  Section 42.0175, Parks and Wildlife Code, is
   6-12  amended to read as follows:
   6-13        Sec. 42.0175.  Expiration Date.  (a)  A <resident hunting>
   6-14  license issued under this chapter, other than a lifetime<, a>
   6-15  resident hunting <exemption> license or<, and> a nonresident
   6-16  five-day special hunting license is <are> valid only during the
   6-17  yearly period for which the license is <licenses are> issued
   6-18  without regard to the date on which a license is acquired.  Each
   6-19  yearly period begins on September 1 of a year and extends through
   6-20  August 31 of the next year.
   6-21        (b)  A license issued under Section 42.012(b) of this code to
   6-22  a person who is 16 years of age at the time the license is issued
   6-23  but reaches the age of 17 during the term of the license is valid
   6-24  for the entire term of the license.
   6-25        SECTION 12.  Section 43.011, Parks and Wildlife Code, is
   6-26  amended to read as follows:
   6-27        Sec. 43.011.  White-Winged Dove Stamp Required.  (a)  Except
    7-1  as provided by Subsection (b) of this section, no <No> person may
    7-2  hunt white-winged dove in this state unless the person <he> has in
    7-3  <his> possession a white-winged dove stamp issued to the person
    7-4  <him> by the department.
    7-5        (b)  The commission by regulation may exempt a person from
    7-6  the stamp requirement of this section.
    7-7        SECTION 13.  Sections 43.014(a) and (b), Parks and Wildlife
    7-8  Code, are amended to read as follows:
    7-9        (a)  An amount set by the commission may be retained from
   7-10  <Fifty cents of> the fee collected under this subchapter <may be
   7-11  retained> by the license deputy <agent of the department, other
   7-12  than a department employee,> as an issuance or <his> collection
   7-13  fee.
   7-14        (b)  After deduction of the issuance or collection fee, if
   7-15  allowed, the receipts from stamp sales shall be sent to the
   7-16  department.
   7-17        SECTION 14.  Section 43.201, Parks and Wildlife Code, is
   7-18  amended to read as follows:
   7-19        Sec. 43.201.  Archery Stamp Required.  (a)  Except as
   7-20  provided by Subsection (c) of this section, no <No> person may hunt
   7-21  wild deer, bear, turkey, or javelina (collared peccary) during an
   7-22  open archery season provided by law or by the proclamations of the
   7-23  commission and during which season only longbows and arrows may be
   7-24  used unless the person has first acquired from the department <or
   7-25  from an authorized agent of the department> an archery hunting
   7-26  stamp.
   7-27        (b)  The stamp shall be issued in the form and manner
    8-1  prescribed by the department and must be signed on its face by the
    8-2  person using the stamp.
    8-3        (c)  The commission by regulation may exempt a person from
    8-4  the stamp requirement of this section.
    8-5        SECTION 15.  Section 43.202, Parks and Wildlife Code, is
    8-6  amended to read as follows:
    8-7        Sec. 43.202.  Fee.  The fee for an archery hunting stamp is
    8-8  $6 or an amount set by the commission, whichever amount is more.
    8-9  An amount set by the commission <Fifty cents> shall be retained
   8-10  from the fee by the license deputy <agent> issuing the stamp and
   8-11  collecting the fee as an issuance or <a> collection fee<, except
   8-12  that employees of the department may not retain the collection
   8-13  fee>.
   8-14        SECTION 16.  Section 43.251, Parks and Wildlife Code, is
   8-15  amended to read as follows:
   8-16        Sec. 43.251.  Turkey Stamp Required.  (a)  Except as provided
   8-17  by Subsection (b) of this section, no <No> person may hunt turkeys
   8-18  in this state unless the person has in <his> possession a turkey
   8-19  stamp issued to the person <him> by the department.
   8-20        (b)  The commission by regulation may exempt a person from
   8-21  the stamp requirement of this section.
   8-22        SECTION 17.  Section 43.252(a), Parks and Wildlife Code, is
   8-23  amended to read as follows:
   8-24        (a)  The department <or its agent> may issue a turkey stamp
   8-25  to any person on the payment to the department of $5 or an amount
   8-26  set by the commission, whichever amount is more.  The stamp must be
   8-27  signed on its face by the person to whom it is issued for the stamp
    9-1  to be valid for hunting purposes.
    9-2        SECTION 18.  Sections 43.254(a) and (b), Parks and Wildlife
    9-3  Code, are amended to read as follows:
    9-4        (a)  An amount set by the commission may be retained from
    9-5  <Fifty cents of> the fee collected under this subchapter <may be
    9-6  retained> by the license deputy <agent of the department, other
    9-7  than a department employee,> as an issuance or a collection fee.
    9-8        (b)  After deduction of an issuance or <any> collection fee,
    9-9  the net receipts from stamp sales shall be sent to the department.
   9-10        SECTION 19.  Section 43.302, Parks and Wildlife Code, is
   9-11  amended to read as follows:
   9-12        Sec. 43.302.  Waterfowl Stamp Required.  (a)  Except as
   9-13  provided by Subsection (b) of this section, no <No> person may hunt
   9-14  waterfowl in this state unless the person has in the person's <his>
   9-15  possession a waterfowl stamp issued to the person <him> by the
   9-16  department.
   9-17        (b)  The commission by regulation may exempt a person from
   9-18  the stamp requirement of this section.
   9-19        SECTION 20.  Section 43.305(a), Parks and Wildlife Code, is
   9-20  amended to read as follows:
   9-21        (a)  An amount set by the commission may be retained from
   9-22  <Fifty cents of> the fee collected under this subchapter <may be
   9-23  retained> by the license deputy <agent of the department, other
   9-24  than a department employee,> as an issuance or <a> collection fee.
   9-25        SECTION 21.  Section 43.402, Parks and Wildlife Code, is
   9-26  amended by amending Subsection (a) and adding Subsection (c) to
   9-27  read as follows:
   10-1        (a)  Except as provided by Subsection (b) or (c) of this
   10-2  section, no person may engage in fishing in saltwater for sporting
   10-3  purposes in this state unless the person has in the person's <his>
   10-4  possession a saltwater sportfishing stamp issued to the person
   10-5  <him> by the department.
   10-6        (c)  The commission by regulation may exempt a person from
   10-7  the stamp requirement of this section.
   10-8        SECTION 22.  Section 43.403(a), Parks and Wildlife Code, is
   10-9  amended to read as follows:
  10-10        (a)  The department <or its agent> may issue a saltwater
  10-11  sportfishing stamp to any person on the payment to the department
  10-12  of $5 or an amount set by the commission, whichever amount is more.
  10-13  The stamp must be signed on its face by the person to whom it is
  10-14  issued.
  10-15        SECTION 23.  Subchapter L, Chapter 43, Parks and Wildlife
  10-16  Code, as added by Chapter 640, Acts of the 69th Legislature,
  10-17  Regular Session, 1985, is amended by adding Section 43.4035 to read
  10-18  as follows:
  10-19        Sec. 43.4035.  EXPIRATION OF STAMP.  (a)  A saltwater
  10-20  sportfishing stamp issued before September 1 that does not expire
  10-21  until August 31 of the following year is valid from the date of
  10-22  issuance through August 31 of the following year.
  10-23        (b)  A saltwater sportfishing stamp issued in conjunction
  10-24  with a license issued under Section 46.005 or 46.0051 of this code
  10-25  expires at the same time the license expires or on the expiration
  10-26  date printed on the stamp, whichever is later.
  10-27        SECTION 24.  Section 43.405, Parks and Wildlife Code, is
   11-1  amended to read as follows:
   11-2        Sec. 43.405.  ISSUANCE OR COLLECTION FEES.  (a)  An amount
   11-3  set by the commission may be retained from <Fifty cents of> the fee
   11-4  collected under this subchapter <shall be retained> by the license
   11-5  deputy <agent of the department, other than a department employee,>
   11-6  as an issuance or <a> collection fee.
   11-7        (b)  After deduction of the issuance or collection fee, the
   11-8  net receipts from stamp sales shall be sent to the department.
   11-9        (c)  The stamp sale net receipts shall be spent for coastal
  11-10  fisheries enforcement and management and are hereby appropriated
  11-11  for such purposes.
  11-12        SECTION 25.  Section 43.502, Parks and Wildlife Code, is
  11-13  amended by amending Subsection (a) and adding Subsection (c) to
  11-14  read as follows:
  11-15        (a)  Except as provided by Subsection (b) or (c) of this
  11-16  section, no <No> person may take or attempt to take any trout from
  11-17  public waters without having in possession a freshwater trout stamp
  11-18  issued by the department.
  11-19        (c)  The commission by regulation may exempt a person from
  11-20  the stamp requirement of this section.
  11-21        SECTION 26.  Section 43.503(a), Parks and Wildlife Code, is
  11-22  amended to read as follows:
  11-23        (a)  The department <or its agent> may issue a freshwater
  11-24  trout stamp to any person on the payment to the department of $5 or
  11-25  an amount set by the commission, whichever amount is more.  The
  11-26  stamp must be signed on its face by the person to whom it is issued
  11-27  for the stamp to be valid for fishing purposes.
   12-1        SECTION 27.  Sections 43.505(a) and (b), Parks and Wildlife
   12-2  Code, are amended to read as follows:
   12-3        (a)  An amount set by the commission may be retained from
   12-4  <Fifty cents of> the fee collected under this subchapter <may be
   12-5  retained> by the license deputy <agent of the department, other
   12-6  than a department employee,> as an issuance or <a> collection fee.
   12-7        (b)  After deduction of any issuance or collection fee, the
   12-8  net receipts from stamp sales shall be sent to the department.
   12-9        SECTION 28.  Section 43.522, Parks and Wildlife Code, is
  12-10  amended by amending Subsection (a) and adding Subsection (c) to
  12-11  read as follows:
  12-12        (a)  The department <or its agent> may issue a conservation
  12-13  permit to any person or group of persons on the payment to the
  12-14  department <or agent> of a fee in an amount set by the commission.
  12-15  <The fee charged for a conservation permit may not exceed the
  12-16  amount charged by the department for a combination hunting and
  12-17  fishing license under Section 50.002 of this code.>
  12-18        (c)  If a permit issued under this section is lost or
  12-19  destroyed, a duplicate may be issued on application of the permit
  12-20  holder and receipt of an amount set by the commission.  The
  12-21  commission may set other conditions for issuance of the duplicate
  12-22  permit.
  12-23        SECTION 29.  Sections 43.524(a) and (b), Parks and Wildlife
  12-24  Code, are amended to read as follows:
  12-25        (a)  An amount set by the commission may be retained from
  12-26  <Fifty cents of> each conservation permit fee collected under
  12-27  Section 43.522 of this code by a license deputy <an agent of the
   13-1  department, other than a department employee, may be retained> as
   13-2  an issuance or <a> collection fee <by the agent>.
   13-3        (b)  After deducting an issuance or <a> collection fee under
   13-4  Subsection (a) of this section, a license deputy <an agent of the
   13-5  department> shall send to the department the net receipts from the
   13-6  sale of conservation permits.
   13-7        SECTION 30.  Section 46.0011(1), Parks and Wildlife Code, is
   13-8  amended to read as follows:
   13-9              (1)  "Resident" means:
  13-10                    (A)  an individual who has resided continuously
  13-11  in this state for more than six months immediately before applying
  13-12  for a fishing license required by this chapter;
  13-13                    (B)  a member of the armed forces on active duty;
  13-14                    (C)  a dependent of a member of the armed forces
  13-15  on active duty; or
  13-16                    (D)  a member of any other category of
  13-17  individuals that the commission by regulation designates as
  13-18  residents.
  13-19        SECTION 31.  Section 46.002(a), Parks and Wildlife Code, is
  13-20  amended to read as follows:
  13-21        (a)  A license issued under this chapter is not required of a
  13-22  person:
  13-23              (1)  under 17 years old; <or>
  13-24              (2)  65 years old or older if the person is a resident
  13-25  or, if a nonresident, if the person's state of residence grants a
  13-26  similar exemption to Texas residents; or
  13-27              (3) <(2)>  who is mentally disabled and who is engaging
   14-1  in recreational fishing as part of medically approved therapy, and
   14-2  who is fishing under the immediate supervision of personnel
   14-3  approved or employed by a hospital, residence, or school for
   14-4  mentally disabled persons.
   14-5        SECTION 32.  Section 46.004(d), Parks and Wildlife Code, is
   14-6  amended to read as follows:
   14-7        (d)  The license deputy issuing the license and collecting
   14-8  the fee may retain from the fee an amount set by the commission <50
   14-9  cents> as a fee for collecting the license fee and issuing the
  14-10  license.
  14-11        SECTION 33.  Section 46.005(b), Parks and Wildlife Code, is
  14-12  amended to read as follows:
  14-13        (b)  The fee for the temporary sportfishing license is $5 or
  14-14  an amount set by the commission, whichever amount is more.  An
  14-15  amount set by the commission <Fifty cents> may be retained from the
  14-16  fee as an issuance or <a> collection fee by the license deputy
  14-17  <issuing officer, other than a department employee>.
  14-18        SECTION 34.  Section 46.0051(b), Parks and Wildlife Code, is
  14-19  amended to read as follows:
  14-20        (b)  The license fee is $7 or an amount set by the
  14-21  commission, whichever amount is more.  An amount set by the
  14-22  commission <Fifty cents of the fee> may be retained from the fee as
  14-23  an issuance or <a> collection fee by the license deputy <issuing
  14-24  officer, other than a department employee>.
  14-25        SECTION 35.  Sections 46.006(b) and (c), Parks and Wildlife
  14-26  Code, are amended to read as follows:
  14-27        (b)  The application for a duplicate license must be an
   15-1  affidavit containing:
   15-2              (1)  a statement of fact <the facts> concerning the
   15-3  loss or destruction of the license; and
   15-4              (2)  any other information or form the commission by
   15-5  regulation may prescribe as necessary <the serial number of the
   15-6  lost or destroyed license>.
   15-7        (c)  The license deputy issuing the license may retain an
   15-8  amount set by the commission <50 cents> as a fee for issuing the
   15-9  duplicate license or collecting the fee.
  15-10        SECTION 36.  Section 46.007, Parks and Wildlife Code, is
  15-11  amended to read as follows:
  15-12        Sec. 46.007.  Expiration of Licenses.  (a)  Except as
  15-13  provided by Subsections (b) and (c) of this section, a <A> license
  15-14  required or authorized by this subchapter is valid only during the
  15-15  yearly period for which it is issued without regard to the date on
  15-16  which the license is acquired.  Each yearly period begins on
  15-17  September 1 of a year and extends through August 31 of the next
  15-18  year.
  15-19        (b)  A license issued under Section 46.005 or 46.0051 of this
  15-20  code is valid for the number of consecutive days authorized and
  15-21  does not necessarily expire on August 31.
  15-22        (c)  A license issued under Section 46.004 of this code that
  15-23  is issued before September 1 and does not expire until August 31 of
  15-24  the following year is valid from the date of issuance through
  15-25  August 31 of the following year.
  15-26        (d)  A duplicate license is valid for the period of validity
  15-27  of the original license only.
   16-1        SECTION 37.  Section 46.008, Parks and Wildlife Code, is
   16-2  amended to read as follows:
   16-3        Sec. 46.008.  LICENSE INFORMATION.  A license issued under
   16-4  this subchapter must contain information determined by the
   16-5  commission to be necessary.<:>
   16-6              <(1)  the year for which the license is issued (printed
   16-7  across the face of the license);>
   16-8              <(2)  the name, address, and residence of the licensee;>
   16-9              <(3)  an approximate weight, height, age, and color of
  16-10  hair and eyes of the licensee for identification in the field; and>
  16-11              <(4)  the statement:  "This license does not entitle
  16-12  the holder to fish on the enclosed and posted lands of another
  16-13  without the consent of the owner or his agent.">
  16-14        SECTION 38.  Section 46.104(b), Parks and Wildlife Code, is
  16-15  amended to read as follows:
  16-16        (b)  The fee for the license is $5.75 or an amount set by the
  16-17  commission, whichever amount is more.  An amount set by the
  16-18  commission <Seventy-five cents of the fee> may be retained from the
  16-19  fee by the license deputy as an issuance or collection fee <issuing
  16-20  officer, other than a department employee>.
  16-21        SECTION 39.  Section 46.105(b), Parks and Wildlife Code, is
  16-22  amended to read as follows:
  16-23        (b)  The fee for the license is $1.25 or an amount set by the
  16-24  commission, whichever amount is more.  An amount set by the
  16-25  commission <Fifteen cents of the fee> may be retained from the fee
  16-26  by the license deputy as an issuance or collection fee <officer
  16-27  issuing the license, other than a department employee>.
   17-1        SECTION 40.  Section 46.106, Parks and Wildlife Code, is
   17-2  amended to read as follows:
   17-3        Sec. 46.106.  Form of License.  Licenses issued under this
   17-4  subchapter shall be on the form prescribed by the department and
   17-5  must contain<:>
   17-6              <(1)  the name and address of the licensee;>
   17-7              <(2)  a personal description of the licensee;>
   17-8              <(3)  date of issuance of the license; and>
   17-9              <(4)  other> information necessary for enforcement of
  17-10  this subchapter as required by the department.
  17-11        SECTION 41.  Section 50.002(c), Parks and Wildlife Code, is
  17-12  amended to read as follows:
  17-13        (c)  License deputies <Authorized agents of the department,
  17-14  other than employees of the department,> may retain from <$1 of>
  17-15  the fee an amount set by the commission as an issuance or <a>
  17-16  collection fee.
  17-17        SECTION 42.  Chapter 50, Parks and Wildlife Code, is amended
  17-18  by adding Section 50.0021 to read as follows:
  17-19        Sec. 50.0021.  EXPIRATION OF LICENSES.  (a)  Except as
  17-20  provided by Subsections (b) and (c) of this section, a license
  17-21  required or authorized by this chapter is valid only during the
  17-22  yearly period for which the license is issued without regard to the
  17-23  date on which the license is acquired.  Each yearly period begins
  17-24  on September 1 of a year and extends through August 31 of the next
  17-25  year.
  17-26        (b)  A license issued under the authority of this chapter
  17-27  that is issued before September 1 and does not expire until August
   18-1  31 of the following year is valid from the date of issuance through
   18-2  August 31 of the following year.
   18-3        (c)  A lifetime resident combination hunting and fishing
   18-4  license is valid for the lifetime of the license holder.
   18-5        SECTION 43.  Section 71.013, Parks and Wildlife Code, is
   18-6  amended to read as follows:
   18-7        Sec. 71.013.  FEES OF LICENSE DEPUTY <ISSUING AGENTS>.  A
   18-8  license deputy <County clerks and other authorized agents of the
   18-9  department other than employees of the department> may retain from
  18-10  <75 cents of> the fee for the issuance of  a trapper's license, a
  18-11  retail fur buyer's license, or a wholesale fur dealer's license an
  18-12  amount set by the commission as an issuance or <a> collection fee.
  18-13        SECTION 44.  Sections 42.009, 42.011, 46.009, 46.010, 46.011,
  18-14  and 46.012, Parks and Wildlife Code, are repealed.
  18-15        SECTION 45.  (a)  Except as provided by Subsection (b) of
  18-16  this section, this Act takes effect September 1, 1993.
  18-17        (b)  Sections 2, 3, 4, 23, 28, 30, and 42 of this Act take
  18-18  effect July 15, 1993.
  18-19        SECTION 46.  The importance of this legislation and the
  18-20  crowded condition of the calendars in both houses create an
  18-21  emergency and an imperative public necessity that the
  18-22  constitutional rule requiring bills to be read on three several
  18-23  days in each house be suspended, and this rule is hereby suspended,
  18-24  and that this Act take effect and be in force according to its
  18-25  terms, and it is so enacted.
