12-1 COMMITTEE AMENDMENT NO. 1
12-2 Amend Sec. 401.270, Health and Safety Code, in SECTION 1 of
12-3 SB 1043 by adding a new subsection (f) to read as follows:
12-4 "(f) If the order issued by the Commission pursuant to this
12-5 section is adopted without notice or hearing, the order shall set a
12-6 time at least ten (10) but not more than thirty (30) days following
12-7 the date of issuance of the emergency order and a place for a
12-8 hearing to be held in accordance with the rules of the Commission.
12-9 As a result of this hearing, the Commission shall decide whether to
12-10 affirm, modify, or set aside the emergency order. All provisions
12-11 of the emergency order shall remain in force and effect during the
12-12 pendency of the hearing, unless otherwise altered by the
12-13 Commission."

13-6 (b) "Disposal" includes the possession, storage, transfer,
13-7 processing, or other activities that are incidental to the final
13-8 disposition of a radioactive substance that occurs after the
13-9 radioactive substance is no longer suitable for its original
13-10 intended purpose."
