   1-15                         A BILL TO BE ENTITLED
   1-16                                AN ACT
   1-17  relating to consultation with a lawyer in a criminal case.
   1-18        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-19        SECTION 1.  Chapter 38, Code of Criminal Procedure, is
   1-20  amended by adding Article 38.36 to read as follows:
   1-21        Art. 38.36.  CONSULTATION WITH A LAWYER.  The act of
   1-22  contacting or retaining an attorney shall not be used against any
   1-23  individual or entity unless that act falls within an established
   1-24  crime-fraud exception.
   1-25        SECTION 2.  This Act takes effect September 1, 1993.
   1-26        SECTION 3.  The importance of this legislation and the
   1-27  crowded condition of the calendars in both houses create an
   1-28  emergency and an imperative public necessity that the
   1-29  constitutional rule requiring bills to be read on three several
   1-30  days in each house be suspended, and this rule is hereby suspended,
   1-31  and that this Act take effect and be in force according to its
   1-32  terms, and it is so enacted.
