                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the escape of a child while an appeal is pending.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Chapter 56, Family Code, is amended by adding
    1-4  Section 56.03 to read as follows:
    1-5        Sec. 56.03.  ESCAPE OF A CHILD.  When any escape from custody
    1-6  by a child occurs while the child has an appeal pending, the Texas
    1-7  Youth Commission or any juvenile detention facility where the child
    1-8  was in custody shall immediately report the fact under oath to the
    1-9  district or county attorney of the county in which the judgment of
   1-10  adjudication or transfer was had.  The report shall be prima facie
   1-11  evidence of the fact of the escape and, on petition by the district
   1-12  or county attorney, shall authorize the dismissal of the child's
   1-13  pending appeal.  On receipt of the report the district or county
   1-14  attorney shall notify the appellate court of the fact of the
   1-15  escape.
   1-16        SECTION 2.  This Act takes effect September 1, 1993.
   1-17        SECTION 3.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency and an imperative public necessity that the
   1-20  constitutional rule requiring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended.
